This is a curious response given that Lothian have made fleet information available previously under FOISA.

It does also appear that your request has not been handled correctly as there has been no refusal notice as is required under §16 of the Freedom of Information (Scotland) Act 2002. The refusal notice needs to be based on the exemptions made available in the legislation, and LB's response fails to do so.

To their credit, it appears the request has never reached their FoI team as it is Customer Services that have responded - but - that isn't an excuse, as, an email from WDTK is a reasonably clear indicator of a FoI/FoISA request. May I suggest that you request an internal review?
