Dear Lambeth Borough Council,

This FOI Request is with regards to the Bus Lane and penalties issued for it on 113 Lambeth Road, London SE1 7LS.

113 Lambeth Road is the Novotel Hotel which has its won underground Parking. To access this parking a driver has to move from the right hand lane into the bus lane so that they can safely enter the car park.

There is no other way to enter the car par without going on to the bus lane first and subsequently turning into the underground car park. Lambeth only issues bus lane penalties after a human operator views the video, so it would be very hard for a human to miss the fact that the driver has come onto the bus lane to turn into the car park.

Hence understating this issue, in the past 3 months from this date:

1) How many penalties have been issues for the Bus Lane on 113 Lambeth Road?
2) Out of these penalties, how many cars were actually turning into the Novotel car park?
3) Out of these penalties, how many video recordings that are put on the Lambeth Website against the penalty were purposely stopped just before the car turned into the car park, to make it look like it was not turning?
4) How many of the bus lane penalties before issuing, were reviewed by another operator?

I am writing to request an internal review of Lambeth Borough Council's handling of my FOI request 'Bus Lane Moitoring on 113 Lambeth Road, London SE1 7LS'.

The questions I specifically asked you and you have not addressed correctly are as follows:

2) Out of these penalties, how many cars were actually turning into
the Novotel car park?

Please provide a confirmation that the figure of 23 you quote were all turning into the Hotel's Car Park.

3) Out of these penalties, how many video recordings that are put on the Lambeth Website
against the penalty were purposely stopped just before the car turned into the car park, to
make it look like it was not turning?

Please provide a confirmation that you have not put up any video on the Website which stop right before the car turns into the Hotel's Car Park to make it look like as if it was still going ahead. I know of atleast one instance where you have made the footage look like this. So please come clean.

Thank you for your request (FOI Review ref IR135703) for an internal
review. I am sorry that you are dissatisfied with our attempts to handle
your request under the Freedom of Information Act 2000.

Your original request dated 22 November 2015 was for

In the past 3 months from this date:

     1) How many penalties have been issues for the Bus Lane on 113

     3) Out of these penalties, how many video recordings that are put

     on the Lambeth Website against the penalty were purposely stopped

     just before the car turned into the car park, to make it look like

     it was not turning?

     4) How many of the bus lane penalties before issuing, were reviewed

     by another operator?

 

On 1 December 2015, the information was supplied to you.  On 4 December
2015, you followed up with two supplementary questions which were as
follows.

Out of these penalties, how many cars were actually turning into the
Novotel car park?  Please provide a confirmation that the figure of 23 you
quote were all turning into the Hotel's Car Park.

Out of these penalties, how many video recordings that are put on the
Lambeth Website against the penalty were purposely stopped just before the
car turned into the car park, to make it look like it was not turning?

 

The CCTV team manager, has confirmed that all Automatic Number Plate
Recognition (ANPR) capture contraventions are reviewed by CCTV officers
before a PCN is issued. Vehicles turning left to enter the Novotel would
not usually be issued a PCN unless they have travelled more than 20 metres
in the bus lane before turning.  If the registered keeper of the vehicle
feels the PCN was issued unfairly, they have the statutory right to make
representations against the PCN and to appeal to an independent
adjudicator if the representations to the council are unsuccessful.

I am unable to comment on the specific circumstances of other cases.
