You asked:
A bus gate sign (953) has been placed on the traffic lights at the above
junction. Can you send me:
1. A copy of the document authorising the siting of a bus gate at this
location.

Our response:
1. Attached is a redacted copy of a report from 2010 that reviews the
location.
2. The location layout and lines and signage comply with statutory
regulations given in the Traffic Signs Regulations & General
Directions. The attached traffic order designates the restrictions in
place at this location.
3. In 2014/15, 21,173 penalty charge notices were issued for bus lane
contraventions in Clapham Park Road.

I am writing to request an internal review of Lambeth Borough Council's handling of my FOI request 'Bus Gate at Junction of Clapham Park Road and Abbeville Lane'.
I was sent information about the 2010 W S Atkins review of the bus lane but my specific points about sign 953 have not been answered. I was told that a further response would be sent by 21 Aug but this deadline has been missed.
Sign 953 is for bus gates and bus only streets so I am querying why it has been used at this bus lane, its size which seems to be below the minimum authorised in regulations and its location which does not appear to be in accordance with regulations. Also the absence of sign 953.2 which is mandatory and I am requesting a copy of the documents authorising the erection and siting of the sign.

The Council has now conducted a review of your complaint which is not
upheld for the following reasons:
On 23 June your original request reads as follows:

2. A copy of the documents detailing and approving the signs and road
markings for this bus gate.
3. The number of PCNs issued for contravention of this bus gate (excluding
34J PCNs for being in the bus lane prior to the bus gate).
On 3 July the Council's response attached a redacted copy of a report from
2010 that reviews the location. The location layout and lines and signage
comply with statutory regulations given in the Traffic Signs Regulations &
General Directions and states that in 2014/15, 21,173 penalty charge
notices were issued for bus lane contraventions in Clapham Park Road.
On 24 July your complaint reads as follows:
The information that has been provided relates to the bus lane at Clapham
Park Road but I requested information about the bus gate at Clapham Park
Road not the bus lane.
Our review response
I have asked Bala Balaskanthan, Senior Project Engineer, about the site
that is the subject of this FOI review. He confirmed to me that there is
no separate traffic order required for this bus lane as this is not a 'bus
only' lane as it is shared with cycles and taxis. Therefore, Diag 953 is
adequate to enforce under TSRGD2002. There is no legal requirement needed
to distinguish Clapham Park Road bus lane as a bus gate.
A bus gate is for bus only roads allowing priority for buses (with Diag
953.3) and needs to have a separate order but this is not applicable in
this case.
I do accept that the Council incorrectly repeated the word of bus gate in
the response because of the way in which the question was phrased which
may have led to this misunderstanding for which I apologise.

Dear Internal review team,
Thank you for your response. This has clarified that this is not a bus gate or a bus only street which was the main purpose for the FOI request. Since sign 953 is normally associated with bus gates and bus only streets I needed to check on that point. I am not sure why it has been used at this location within the island but there is no doubt a good reason.
