Dear Derby City Council,

This request is being made to make the public at large and people in each authority aware of which councils are the worst offenders or the better examples when it comes to bullying in the workplace. All councils have very similar anti-bullying / dignity at work policies, but there seems to be a difference in the level of bullying. This is intended to statistically show those differences.

1) How many employees of your authority have
made an
official complaint of harassment and bullying at work since the 1st April 2009?

2) How many of these complaints were upheld in favour of the
complainant?

3) How many of those which were not upheld in favour of the
complainant went on to Appeal?

4) How many of those that went to Appeal were found to favour the
complainant?

5) How many complaints went on to an Employment Tribunal?

6) How many of these were found to uphold the complaint?

7) Out of how many of those allegations (the number given to question 1) did the complainant of
bullying claim that the bullies were telling lies?

8) How many staff does your authority have and what is the current population within your authority's area?

This does not restrict your rights under the fair dealing provisions of
the Copyright, Designs and Patents Act 1988.

 

We are unable to provide you with the information you have requested for
the time period 01/04/2009 to 31/03/2014.

 

This is because the cost of locating and retrieving the information
exceeds the ‘appropriate limit’ as stated in the Freedom of Information
and Data Protection (appropriate limit and fees) Regulations 2004.

 

In accordance with the Freedom of Information Act 2000 this letter acts as
a Part Refusal Notice. 

The exemption applied is Section 12: Exceeds Appropriate Limit.

In order to provide an accurate answer to the information required for the
period 01/04/2009 to 31/03/2014, we would need to manually access and
compile the relevant information for approximately 59 investigation cases
at 10 minutes each & 74 paper records at 40 minutes each which in total
would equate to over 59 hours of staff time therefore, exceeding the
appropriate limit of 18 hours.

 

I apologise that your request will not be met in full but if you have any
further information needs in the future then please contact me.

The investigating officer has considered your internal review request and
the decision/response is shown below …

 

“I have considered the appeal/complaint from Mr Lewis. I have treated this
as a complaint rather than an appeal, as he makes no reference to the use
of the exemption applied (Section 12: Exceeds Appropriate Limit). Instead
he refers to the fact that he is “complaining about the very poor way in
your setting out of the replies, with words missing.”

 

I’ve looked at the original 15 December FOI response.  I have to say I
cannot see a problem with any left justification and words missing. I
don’t think the paragraph explaining the use of exemption 12 looks good in
the context of the rest of the response. I note a revised response letter
was sent to Mr Lewis on 22nd December following his email of complaint
about the presentation of the response on 17th December. This looks more
professional. This addresses Mr Lewis’ complaint , prior to his more
formal complaint dated 2^nd January 2016.

    

I also note that Mr Lewis comments “Like everyone else, referring your
answer to the question number would have been better.” However, given that
the actual question had been included in the response to the applicant
with the information/answer written against it, I cannot see the issue
here”.
