Bullying in Denbighshire Council

Yabootoyou made this Freedom of Information request to Denbighshire Council

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was refused by Denbighshire Council.

Dear Denbighshire Council,

Following a realization that bullying in Cheshire East is about six times higher than in Cheshire West and Chester and having seen accusations of a culture of bullying in the former on the internet, combined with my own experiences of bullying in Cheshire County Council's Public Rights of Way unit and my own efforts to withstand that bullying (display of ID card of ex-employee in manager's office with picture of cow replacing her ID photo ([name removed]) or "anyone thinking of complaining yaboo to you" by [name removed] once complaints of bullying had been made) and the evidence of bullies in Employment Tribunal (which chopped and changed), this FOI request is being made to provide a comparison with Cheshire East to prove statistically in relation with other councils. It is also being made to make the public at large and in each authority aware of which councils are the worst offenders or the better examples. All councils have very similar anti-bullying / dignity at work policies, to which, from the results already in, they seem to stick to varying degrees. For example, the first non-Cheshire authority to reply, Kent County Council, shows 60 complaints against Cheshire East's 62, with both having 18 upheld in favour of the complainant. However, Kent's population is around 5 times greater than Cheshire East's. Also, Cheshire East replied to this FOI Act request 8 days late with no communication between the deadline and the 8 days after, whereas Kent replied 11 days after the request was made.

1) How many employees of your authority have
made an
official complaint of harassment and bullying at work since the 1st April 2009?

2) How many of these complaints were upheld in favour of the
complainant?

3) How many of those which were not upheld in favour of the
complainant went on to Appeal?

4) How many of those that went to Appeal were found to favour the
complainant?

5) How many complaints went on to an Employment Tribunal?

6) How many of these were found to uphold the complaint?

7) Out of how many of those allegations (the number given to question 1) did the complainant of
bullying claim that the bullies were telling lies?

8) How many staff does your authority have and what is the current population within your authority's area?

Yours faithfully

Mr Lewis

Craig Berry, Denbighshire Council

Dear Mr Lewis,

I note form your recent email dated 1st December 2015 that you have
requested an internal review of request reference 182 regarding bullying
and harassment figures.  The reason you have requested a review appears to
be because we were late in responding.

Although we strive to respond to all information requests within their
statutory timescales, this is not always possible.  On this occasion, it
does appear that we were a couple of days late in responding, for which we
apologise.

The internal review system has been established to provide requestors with
an opportunity to challenge responses provided by the Council rather than
not responding within timescales.  I'm therefore minded not to progress
with an internal review unless you have a reason for wanting to challenge
the response provided to you.

Please don’t hesitate to contact me, should you wish to discuss further.

Regards,

Craig Berry

Dear Craig Berry,

I would like to add the following question to my request.

Q9) Out of the number in the response to question 1, how many of
the complainants said that they had been called "a loner"?

Yours sincerely,

Mr Lewis

Section 12. Appropriate Limit

--------------------------------------------------------------------------

Dear Mr Lewis,
Thank you for your request for information received 01/02/2016 regarding
BULLYING AT WORK Q9 - Out of the number in the response to question 1, how
many of   the complainants said that they had been called "a loner"?

Unfortunately it would take over 18 hours to compile a response, as there
are thousands of documents - emails, minutes, personal notes, personnel
records etc - and we are therefore not obliged to provide a response under
Section 12 of the Freedom of Information Act 2000.

To explain: Section 12 FOIA 2000 provides that a public authority is not
obliged to comply with a request for information if it estimates that
meeting the request would exceed the appropriate cost limit. This
‘appropriate limit’ is also set out in the Freedom of Information and Data
Protection (Appropriate Limit and Fees) Regulations 2004. The ‘appropriate
limit’ for non- Central Government public authorities is currently set at
£450. This is calculated at a rate of £25 per member of staff per hour.
This effectively equates to a time limit of 18 staff hours.

In practice this means that if the department(s) estimates that if it
would take more than 18 hours to respond to the whole request the
exemption is engaged. This includes time taken determining whether we hold
the information, finding the requested information, retrieving the
information or records, and extracting the information.

The Service have calculated that providing the requested information would
take over 18 hours and I therefore confirm that the request is refused
under Section 12 of the Freedom of Information Act 2000.
It would be possible to send an email to all HR staff to ask them if they
are aware of any cases of complainants calling themselves loners. Please
let me know if you would like to take this option.
If I can be of any further assistance please do not hesitate to contact
me. Rydym yn croesawu gohebiaeth yn Gymraeg. Byddwn yn ymateb i unrhyw
ohebiaeth yn Gymraeg ac ni fydd hyn yn arwain at unrhyw oedi. We welcome
correspondence in Welsh. We will respond to any correspondence in Welsh
which will not lead to a delay.

If you have any queries regarding this response, please do not hesitate to
contact me at the following address: Access to Information Officer,
Corporate Information Team, County Hall, Wynnstay Road, Ruthin, LL15 1YN.
Alternatively, if you are unhappy with the way the council has handled
your request and wish to ask for internal review, please contact the
Corporate Information Manager at the same address. If you are subsequently
not content with the outcome of the review, you have the right to apply to
the Information Commissioner whose address is Wycliffe House, Water Lane,
Wilmslow, Cheshire, SK9 5AF.
