Building regulations enforcement S36 notices issued.

We're waiting for Adam A to read recent responses and update the status.

Dear Waltham Forest Borough Council,

Please could you provide a response to the following requests for information in respect of Building Act 1984 S36 enforcement action taken since 1st January 2006 (reporting each calendar year separately if possible):-

Residential Property Works:
1. How many Building Act 1984 Section 36 enforcement notices have been issued in respect of residential property works since 1st January 2006 (reporting each calendar year separately if possible) ?

2. How many injunctions have been applied for pursuant to Building Act 1984 Section 36(6) in respect of residential property works since 1st January 2006 (reporting each calendar year separately if possible) ?

Commercial or other Property Works
3. How many Building Act 1984 Section 36 enforcement notices have been issued in respect of other property works, not being residential property works, since 1st January 2006 (reporting each calendar year separately if possible) ?

4. How many injunctions have been applied for pursuant to Building Act 1984 Section 36(6) in respect of other property works, not being residential property works, since 1st January 2006 (reporting each calendar year separately if possible) ?

I am writing to confirm that the Council has now completed its search for
the information which you requested on 18 Apr 2017 about Building
regulations enforcement S36 notices issued.

The information supplied has been provided by the department responsible
for the service delivery.

1. The information requested is not saved/recorded in a searchable format
so we have no way of interrogating the database to provide a definitive or
truly accurate response, however from general inter officer discussion we
estimate that around 10 Section 36 Notices (28 day notices) are served on
residential properties per year.

2.   The information requested is not saved/recorded in a searchable
format so we have no way of interrogating the database to provide a
definitive or accurate response, however whilst we recall that some have
progressed to court under 36(3) to seek/force action, we do not recall
applying for any injunctions pursuant to Section 36(6) of the Building Act
1984 in respect of building regulation matters.

3. The information requested is not saved/recorded in a searchable format
so we have no way of interrogating the database to provide a definitive or
accurate response, however from general inter officer discussion we
estimate that around 4 Section 36 Notices (28 day notices) are served on
commercial properties per year.

4. The information requested is not saved/recorded in a searchable format
so we have no way of interrogating the database to provide a definitive or
accurate response, however whilst we recall that a percentage have
progressed to court under 36(3) to seek/force action, we do not recall
applying for any injunctions pursuant to Section 36(6) of the Building Act
1984 in respect of building regulation matters.
