Building regulations enforcement S36 notices issued.

We're waiting for Adam A to read a recent response and update the status.

Dear Hillingdon Borough Council,

Please could you provide a response to the following requests for information in respect of Building Act 1984 S36 enforcement action taken since 1st January 2006 (reporting each calendar year separately if possible):-

Residential Property Works:
1. How many Building Act 1984 Section 36 enforcement notices have been issued in respect of residential property works since 1st January 2006 (reporting each calendar year separately if possible) ?

2. How many injunctions have been applied for pursuant to Building Act 1984 Section 36(6) in respect of residential property works since 1st January 2006 (reporting each calendar year separately if possible) ?

Commercial or other Property Works
3. How many Building Act 1984 Section 36 enforcement notices have been issued in respect of other property works, not being residential property works, since 1st January 2006 (reporting each calendar year separately if possible) ?

4. How many injunctions have been applied for pursuant to Building Act 1984 Section 36(6) in respect of other property works, not being residential property works, since 1st January 2006 (reporting each calendar year separately if possible) ?

I am writing in response to your request for information below.

 

As I understand it you are seeking to know:

 

Residential Property Works:
1. How many Building Act 1984 Section 36 enforcement notices have been
issued in respect of residential property works since 1st January 2006
(reporting each calendar year separately if possible) ?
2. How many injunctions have been applied for pursuant to Building Act
1984 Section 36(6) in respect of residential property works since 1st
January 2006  (reporting each calendar year separately if possible) ?

issued in respect of other property works, not being residential property
works, since 1st January 2006  (reporting each calendar year separately if
possible) ?

We have considered your request and, unfortunately, we do not record data
of this nature in a manner that makes it easy to retrieve and it would
require an extensive manual exercise to locate, extract and collate this
data.

 

S12 of the FOIA states that a Public Authority is not obliged to respond
to a request for information under S1 of the FOIA where it estimates that
the cost of doing so would 'exceed the appropriate limit'.  The
'appropriate limit', as laid down in the Freedom of Information and Data
Protection (Fees and Appropriate Limit) Regulations 2004 (the
'Regulations'), is £450 which equates to 18 hours work. 

 

We estimate that the cost of searching our records to ascertain whether
the information is held and to collate this information would be over the
'appropriate limit' as laid down in the Regulations and as such is exempt
under S12 of the FOIA.
