Building regulations enforcement S36 notices issued.

We're waiting for Adam A to read a recent response and update the status.

Dear Enfield Council,

Please could you provide a response to the following requests for information in respect of Building Act 1984 S36 enforcement action taken since 1st January 2006 (reporting each calendar year separately if possible):-

Residential Property Works:
1. How many Building Act 1984 Section 36 enforcement notices have been issued in respect of residential property works since 1st January 2006 (reporting each calendar year separately if possible) ?

2. How many injunctions have been applied for pursuant to Building Act 1984 Section 36(6) in respect of residential property works since 1st January 2006 (reporting each calendar year separately if possible) ?

Commercial or other Property Works
3. How many Building Act 1984 Section 36 enforcement notices have been issued in respect of other property works, not being residential property works, since 1st January 2006 (reporting each calendar year separately if possible) ?

4. How many injunctions have been applied for pursuant to Building Act 1984 Section 36(6) in respect of other property works, not being residential property works, since 1st January 2006 (reporting each calendar year separately if possible) ?

We have become aware that at some point in early February Enfield council stopped recieving FOI requests on the email address by which we have been sending FOI requests to them for the last 9 years. The Council did not inform us that they no longer had access to that email address, nor did their email server refuse transmission of the email sending the request, neither did their server issue a Mail Delivery Failure notification. We find it unhelpful when an authority stops using an email address without setting it to at least bounce emails as this is essentially indistinguishable from the email having been successfully transmitted.

As a result, FOI requests sent in February and March are unlikely to have reached the authority. We sourced an alternative email address and have now re-sent the request to the new address.
