Dear Dundee City Council,

This is a Freedom of Information request. I am interested in information from held by your organisation that relates to the process of planning and preparing for a possible future when the UK may not be a member of the European Union ("Brexit").

In particular:

1. How much has been spent on external consultants or support to advise on the implications and consequences of brexit, or recommend actions to mitigate any possible brexit impacts? If spend has occurred, please confirm the name of the supplier or suppliers and copies of any material produced by this process.

2. Please supply copies of any brexit planning documentation held by the organisation or consumed by senior management. This may include, but should not be limited to, Risk Assessments, Action Plans, Meeting minutes, Reports and presentations.

3. Please supply technical or advisory briefing documentation on brexit that has been produced by the organisation and supplied to other government agencies or bodies.

4. Please supply copies of any technical or advisory documentation that has been supplied to the agency from other public bodies that relates to Brexit contingency planning.

5. Please supply details of any assessment that has been made of the financial impact on the organisation, either positive or negative, of the brexit process. Has the organisation set-aside a contingency fund or invested as a direct consequence of the brexit process? If so, please provide summary details.

I am writing to request an internal review of Dundee City Council's handling of my FOI request 'Brexit planning'.

In my request I sought materials consumed by senior management that relate to Brexit. I note that the reports suggest a Brexit Advisory Group was to be set up in February, but no materials from this group, as well as any other internal meetings on the subject have been included with the initial response.

Dear Mr Tibbitt

   

Your original request

I refer to your email dated 22^nd ^ September 2018 in which you requested
the following information:

 

“I am interested in information from held by your organisation that

The Legal Manager’s response

 

The Legal Manager responded to your request on 27^th ^ September 2018. In
his response, the Legal Manager stated that with regards to your first
question, no such expenditure had been incurred. As for your second
question, two committee reports were attached to the response provided to
you.

 

In response to your third request, it was explained to you that no
documentation exists. With regards to your fourth request, the Legal
Manager informed you that COSLA has been in discussion with the Scottish
and UK Government in terms of the work that might be required for
preparedness and contingency planning in a range of scenarios, and will
seek to analyse the implications of the reports published by the UK
Government on behalf of Scottish Councils.  In terms of your fifth request
the Legal manager responded that the reports attached to the response
indicated that there may be some financial implications as a consequence
of Brexit however as this had not yet been quantified, no fund has been
put aside.  

Your request for Chief Executive review

 

On 27^th^ September 2018 you requested a review of the Legal Manger’s
response. In the request for review you stated that:

The Legal Manager’s response to your request for review

 

With regards to your request for review, I can confirm that a Brexit
Advisory Team has been established to discuss the implications of leaving
the European Union for Dundee. This is an internal working group who aim
to develop policy on the basis of those discussions.

 

It is my position that the information contained within the meeting
minutes of the above groups is however exempt under section under section
30(b)(ii). This is because the disclosure of the minutes would, or would
be likely to inhibit substantially the free and frank exchange of views
for the purposes of deliberation. This is due to the sensitive nature of
the topic discussed and the information provided by the Council officers
and the purpose of the deliberations, namely policy formulation. It is
also within the public interest that such information not be released.

 

It is also my position that the information contained within the meeting
minutes of the above groups is exempt under section 33(2)(b) of the
Freedom of Information (Scotland) Act 2002 as the minutes contain
information, the disclosure of which would substantially prejudice the
financial interests of the Council. It is also within the public interest
that such information not be disclosed.

 

Furthermore, in response to your request to seek materials consumed by
senior management, it may also be useful for you to know that the minutes
of the meetings of the internal groups are not provided to senior
management. Management are instead provided with committee reports, which
were previously sent to you.   

My Conclusion

 

I agree with the position of the Legal Manager that the information
requested by you, in particular the minutes of the meetings of the
internal working groups is exempt.

If you are unhappy with my decision, you may appeal to the Scottish
Information Commissioner.  You must submit your appeal to the Scottish
Information Commissioner within six months of receiving my decision.
