(2)   (RESPONSE)

 

(a)       I can confirm that there has been internal correspondence and
communication which mentions, or refers to, the Brexit Party, by the Local
Returning Officer for the Dacorum counting area.

(b)      I can also confirm that there has been external correspondence
and communication which mentions, or refers to, the Brexit Party, by the
Local Returning Officer for the Dacorum counting area.

 

However, Returning Officers are not public bodies subject to the Freedom
of Information Act. The functions of these officers are separate from the
functions of an authority which employs them and there is no statutory
obligation for a Returning Officer to provide you with information or
supply answers to your questions. Consequently, the Council is unable to
provide you with information that is held by or on behalf of the Returning
Officer where the Council does not also hold that information on its own
behalf.

 

Please note that a list of public bodies and local authorities who are
subject to the provisions of the Freedom of Information Act are listed in
Schedule 1 to the Freedom of Information Act 2000. The Act does not list
any person appointed under the Representation of the People Act 1983. It
therefore follows that the Returning Officer, Electoral Registration
Officer or any other person appointed under the Act are not subject to the
provisions of the Freedom of Information Act.
