Dear Dartmoor National Park Authority,

1. Please provide details of all meetings that have taken place between the DNPA and Brentor Parish Council or any representatives of Brentor Parish Council between the 1st January 2015 and 3rd March 2015. Please include copies of the notes made of these meetings, all other communications relating to these meetings, the names of all persons who attended these meetings, the dates and times of these meetings and the venues used.

2. Please provide copies of all communications between the DNPA and Brentor Parish Council or any representatives of Brentor Parish Council between the 1st January 2015 and 3rd March 2015.

3. Please provide the full list of names of all individuals who attended the DNPA Site Visit to Hammer Park, Brentor in December 2014 - to include the names of all individuals who attended this site visit whether representing the DNPA or other organisations. Please provide copies of the notes used by the Planning Officer/s to brief DNPA members for this site visit, notes made during and after this site visit, copies of the representations made by individuals who attended the site visit and the names of anyone else whom the inspection panel spoke to whilst undertaking this visit.

To be clear the request for all communications in the above requests should include all communications including:copies of letters, emails, faxes, documents and the contemperanuos notes of all conversations.

Having carefully read through the information provided, it appears that a few relevant items have possibly been missed. These are:-

1. A copy of the Brentor Parish Council's statement which was partially read out by a Brentor Parish Councillor at the DNPA Development Management Committee (DMC) held on the 9th January 2015. This statement was attached to an email dated 19th February 2015 sent from this Brentor Parish Councillor to the Chairman of the DMC and which the Brentor Parish Councillor had specifically asked to be circulated to every member of the DMC. Please provide a copy of this.
2. A further email from this Brentor Parish Councillor sent to the Chairman of the DMC, in reply to an acknowledgement email that the Chairman sent to this Parish Councillor on the 20th February 2015. This missing email is referred to in paragraph 1 of the Chairman's later email dated the 24th February 2015. Please provide a copy of this.
3. Correspondence from the DNPA Head of Legal Services - Mr Walledge in respect of allegations that the Brentor Parish Council representative was cut short during their three minute speech at the DMC held on the 9th January 2015.
4.A copy of the notes used by the Planning Officer/s to brief DNPA members before and during the site visit to Hammer Park, held December 2014.
5. On the 17th February the DNPA wrote to the Brentor Parish Council and requested a note from them regarding the meeting held on the evening of 16th February 2015. This note from Brentor Parish Council is missing. Please provide.

I have been unable to locate the documents you refer to in points 1 and 2.

 

The letter from Mr Walledge is attached as requested.

 

There are no notes of the planning officer relating to the committee site
inspection. The notes of the committee site inspection meeting are
contained in the relevant planning application report to committee which
is available to view on our web site.

 

The Parish Council minutes of the meeting held on 16 February 2015 are
available to view on their web site.

Dear Dartmoor National Park Authority,

Freedom Of Information Request: Brentor Parish Council

The DNPA Head of Planning advises that he has not been able to locate the missing documents referred to in points 1 and 2 of my communication dated the 26th March 2015. It is simply not possible (for the reasons detailed below) that the Authority does not hold this information. The failure of the DNPA to provide these documents in response to a FOI request, represents either an unjustifiable withholding of information in contravention of the Freedom of Information Act and/or very poor document control within the DNPA. In order to help you locate these missing documents I have therefore repeated these requests below, along with some further information on who at the DNPA will have copies of these missing documents.

1. I requested a copy of the Brentor Parish Council's full statement of support for planning application 0606/14 that was partially read out by a Brentor Parish Councillor at the DNPA Development Management Committee (DMC) held on the 9th January 2015. I explained that this statement from the Brentor Parish Council/Councillor was attached to an email dated 19th February 2015, sent at 14.41 hrs from this Brentor Parish Councillor to the DMC Chairman. Furthermore this email specifically asked the DMC Chairman to circulate this statement to every member of the DMC. The DMC Chairman definitely received this email as he replied to it by letter on the 24th February 2015, Reference JMcI/SB/AH/0606/14. The email of 19th February with the attached statement that I am seeking was copied in to the Head of Legal and Democratic Services at the DNPA and to the Head of Planning at DNPA who has unfortunately advised that he has been unable to locate this document. If the Head of Planning cannot locate this statement, then I would suggest that you ask the DMC Chairman and/or Head of Legal and Democratic Services at the DNPA if they can locate their copies of it. Furthermore this statement was supposed to have been circulated to all DMC Members, so whoever at the DNPA circulated this statement to DMC Members would have a copy of it, as would all DMC members who received it. It is therefore inconceivable that the DNPA cannot locate a copy of this statement.
2. A further email from this same Brentor Parish Councillor sent to the Chairman of the DMC. This was in reply to an acknowledgement email that the Chairman sent to this Brentor Parish Councillor on the 20th February 2015.This missing email is referred to in paragraph 1 of the DMC Chairman's letter dated the 24th February 2015, reference JMcI/SB/AH/0606/14. The DMC Chairman therefore definitely received this email of the 20th February, from the Brentor Parish Councillor. I would therefore suggest that you ask the DMC Chairman or whoever looks after the Chairman's correspondence for a copy of this missing email. It is inconceivable that the DNPA cannot locate a copy of this document.
3. Correspondence from the DNPA Head of Legal Services - Mr Walledge, in respect of allegations that the Brentor Parish Council
representative was cut short during their three minute speech at the DMC held on the 9th January 2015. This item has been received, so no further action is necessary regards this particular request.
4. A copy of the notes used by the Planning Officer/s to brief DNPA members before and during the site visit to Hammer Park, held
December 2014.The Head of Planning has seemingly advised that such notes as I requested do not exist. If this is the case, then no further action is necessary on this point.
5. On the 17th February the DNPA Head of Planning wrote to the Brentor Parish Council and requested a note from them regarding the meeting held on the evening of 16th February 2015. There appears to be some confusion, as the Head of Planning has directed me to the minutes of the Brentor Parish Council Meeting, which in any case were not published until some considerable time after the event. This is not what I requested. My request was for a copy of the specific note written by Brentor Parish Council and sent to the DNPA, following a request for this note from the Head of Planning on the 17th February 2015. This note from Brentor Parish Council to the DNPA has thus far not been published on the Brentor website.
6. On the 4th March 2015 I responded to a request from the DNPA of the same date to clarify that my FOI request was in respect of all communications between the DNPA and Brentor Parish Council for the period 1st January 2015 and 3rd March 2015. The only information I have received thus far is from the DNPA Planning Directorate. Please ensure that information for all other directorates, committees and authority members for this same time period is supplied forthwith.

I would appreciate if all missing information as described above, could now be provided within the next 5 working days.

Further to your email dated 19 April I have searched my records again for
the requests set out in points 1 and 2 of your email and I regret to
inform you I cannot locate a copy so am unable to provide you with said
copies.

 

With regard to 3 this is dealt with. Similarly with Point 4 I can confirm
there are no briefing notes.

 

With regard to point 5 there is no confusion. My letter asking for a note
of the meeting was actually referring to the minute of the meeting but I
used the word note rather than minute but this is what I meant.

 

With regard to point 6 I am not aware of any missing information that you
have not already been furnished with so am unable to comply with your
request.
