Dear Mr Barker,

 

Thank you for your Freedom of Information request in regards to the Brent
Borough of Culture 2020 project on the 28 August.

We have been working on this request and need some clarification around
the information you want.

We have identified one project that falls within the scope of this
request, the basic details of which I have listed below:

o Brent Council were awarded £250,000 under our Heritage Grants
programme in September 2019 for their project ‘Brent Borough of
Culture 2020’.

In your request you ask to see:

Dear Mr Barker,

 

Many thanks for your email on 16 September 2020 in which you confirmed
that you would like to see the list of documents that we shared with you
via email on the 14 September 2020. As we had to seek clarification on
what you required, as per the FOI Act, the 20 working days starts from the
date you responded to that email, therefore the deadline for this request
is the 14 October 2020. Apologies that this was not communicated to you
and for any confusion caused.

 

We are however now in a position to provide you with the information
requested. Please find attached both a contents page with a list of all
the documents you should expect to receive and a zipped folder containing
all the documents themselves.

 

Please note that there are a of instances of redaction throughout all the
documents which have been made under Section 40 of the Freedom of
Information Act – Personal Information. This exemption allows a public
body to withhold information that could be considered personal to an
individual. In line with the principles set out in the Data Protection
Act, a public body has a duty to protect personal information that it
holds. You will notice that there is extended redactions in ‘5.2.1 AJA
BRENT 2020 London Borough of Culture Freelance Evaluation
Proposal_Redacted' across pp.7-25, this is because they contain an
individuals CV.

 

Please also note that in the document titled ‘5.5 Email_Redacted’ we have
also made redactions under Sections 22 of the FOIA- Future Publication.
This is what is known as a qualified exemption, meaning that it requires
us to complete a public interest test to determine whether the arguments
to withhold this information outweigh those to release. I have set this
out at Appendix 1. Overall we have concluded that the arguments against
disclosure outweigh those in favour. We have marked up where this
exemption applies in the documents, all other redactions are made under
Section 40 as above.

 

If you are unhappy with the service you have received in relation to your
request and wish to request an internal review of our decision please

outcome of the internal review you have the right to appeal to the

Appendix 1- PUBLIC INTEREST TEST

 

Factors in favour of disclosure

o Disclosing the information requested would enhance transparency and
accountability.
o As a publicly funded organisation, the public has a legitimate
interest in The National Lottery Heritage Fund’s activities and
disclosure would increase public awareness about the work of The
National Lottery Heritage Fund and its grantees.

 

Factors against disclosure

o It is not in the interest of The National Lottery Heritage Fund (The
Fund) to release information that has not yet been announced ahead of
a marketing campaign that could reduce its impact.
o It is not in the interest of The Fund to release information that
would go against previous agreements and jeopardise the relationship
with third parties.
