Under section 1(1) of the Freedom of Information Act 2000, any person
making a request for information to a public authority is entitled to be
informed in writing by the public authority whether it holds information
of the description specified in the request, and if that is the case, to
have that information communicated to them.

 

In this case Bolton Council does not maintain a record of historical
vacancies and so is not possible to provide the information requested
without further analysis and creating new information. The Freedom of
Information Act does not require us to create documents, nor to manipulate
data to create new information; therefore the requested information is not
held.

 

A list of empty business and commercial properties is published each month
on the Council’s website and can be accessed via the link below and
through the ‘Downloads’ tab:

Our business rates records do not record what is vacant but whether empty
or occupied charges are payable i.e. so what may look vacant as you walk
past it may not be vacant on our records due to empty rate avoidance
schemes.
