I refer to your request for information under the above Act.

 

You asked us a series of questions on the topic of Oil or Oil storage
facilities in Northern Ireland. Your questions are listed below followed
by HSENI’s response.

 

1. Have any inspections been carried out at oil refineries or oil storage
plants in Northern Ireland?

 

There are no oil refineries in Northern Ireland. There are a number of oil
storage sites in Northern Ireland and those that are subject to The
Control of Major Accident Hazards Regulations (Northern Ireland) 2015, are
inspected at a minimum of every year for upper tier sites and every three
years for lower tier sites.

 

2.  Have any breaches of H&S legislation been discovered during these
inspections?

 

A list of Improvement Notices and Prohibition Notices issued since 2007
are listed in The Public Register of Prosecutions and Enforcement Notices

3.  If so please list the breaches and by what companies, agency or
otherwise?

 

This information is available on The Public Register of Prosecutions and
Enforcement Notices (where formal enforcement action has been taken).

 

4.  What were or what are likely to be the outcome of any breaches
discovered?

 

HSENI follow up with the duty-holder to ensure compliance with the law. If
an enforcement notice has been issued in respect of the breach or breaches
and has not been complied with, this could result in a prosecution case.

5.  Are all staff employed on security duties at the plants in NI
registered with the SIA if employed by security companies?

 

It is not within the powers of the Health and Safety Executive Norther
Ireland to enforce the requirement of registration with the SIA when
required.

 

6. As at 5 Is this checked as part of your inspections?

 

Registration of relevant personnel with the SIA does not form part of
HSENI inspections as it is not a legal requirement under health and safety
law.
