I am writing to request an internal review of Forestry Commission's handling of my FOI request 'Branding'.

You have refused to provide me with a copy of your branding manual because it is intended for future publication. However, according to the Information Commissioner's Freedom of Information Act Awareness Guidance No 7, this exemption is subject to a public interest test, though your response provides no evidence that you carried one out.

Specifically, it is outlined that refusal would be justified: the release of information to the applicant may result in unfairness to others; the public authority may be under a duty to present a report in the first instance to a particular individual; an announcement may be designed to prompt enquiries from the public and may be expected to result in an increase in workloads.

It is clear that none of these circumstances is relevant, and therefore, I would like you to either release me the material, or outline how you carried out your public interest and found that it was in the public interest to withold the material I requested.

FOI REQUEST ON BRANDING

Your request for an internal review has been passed to me in the first
instance. As I'm sure you will be aware, reviews are costly and take
time. We try to resolve any issues with the enquirer informally if we
can to reduce the call on our resources and to speed up our response to
you.

As I said in my earlier email, our brand manual is an internal online
manual that is not yet available externally. We have no reason or wish
not to disclose it but there are technical and practical issues involved
in doing this that will not be overcome until we carry out further
development work and publish it on our external website as planned. We
cannot supply the manual as an offline HTML application as it is
requires our bespoke web content management systems to render it.

However, it is our policy to be as open and helpful as possible and so I
offer you the following options:

1. You are welcome to visit any of our offices to view the manual
online on our internal network. A list of offices is on our website:
www.forestry.gov.uk/contacts

2. We can print off the content of the manual. It is not designed to be
used in this way so links will not work and the manual will lose its
structure. Also, the pages are designed for electronic delivery and
might not print well.

3. We can provide individual html pages electronically, for example as
web archive single files (.mht files). Once again, the page links will
not work and the manual will lose its structure. We are also concerned
that some of the pages may not render correctly.

Please let me know which of these options would best suit your
requirements. If you decide to visit one of our offices I will be
pleased to arrange this for you.

I have spoken with our web team and our graphic designers re a date for
the manual going online. One of the issues with the development is that
the manual does not currently meet the accessibility standards set down
for goverment websites. Some work remains to be done to ascertain how
big the gap is. I'm afraid to say that as the work is still being scoped
we cannot yet predict when it might be finished.

Our web team have been able to create a pdf of the manual and this is
attached. The other options I set out in my earlier email are, of
course, still available to you.

Please note that the supply of this information does not provide an
automatic right to re-use the documents in a way that would infringe
copyright or intellectual property rights, for example, by making
multiple copies, publishing and issuing copies to the public. If you do
wish to reuse information supplied please contact me.
