FREEDOM OF INFORMATION ACT 2000-INFORMATION REQUEST

Your request for information has been considered under the requirements of the Freedom of Information Act and our response is as follows:

Please find enclosed the two specified sets of minutes. You will note some redactions have been made. When the minutes were originally published some information was withhold due to commercial sensitivities. We have determined that these issues still remain and so some information is being withheld under Section 43(2) of the Freedom of Information Act as we believe its release would, or would be likely to, prejudice De Montfort University's commercial interests. The university operates within a competitive environment and detailed financial information, and information related to the ongoing recruitment of students, could provide a competitive advantage to other institutions even though it is several years old as it would indicate the university's ongoing strategies in this regards.

Because Section 43(2) is a qualified exemption we are obliged to undertake the Public Interest Text. Whilst we except there is a public interest in how universities are run, and that transparency and accountability are important, we do not believe this public interest overrides the greater public interest in universities being able to operate on a level playing field within a competitive environment, especially given that the university does provide significant information within its annual financial statement. As such we find the exemption to be fully engaged.
