I’m afraid this is quite an inadequate response to my initial request, in which it should have been pretty clear that I was looking for specific explanations for each redaction rather than a general explanation of why you might redact these documents.

Whether you want to treat this as a new request or an extension of the existing one, please provide me with explanations for each redaction in the Board and ARAC minutes for 2018.

If this would prove too burdensome in terms of time, please provide the explanations for the redactions for as many as possible within the budgetary constraints, starting with the most recent published.

Dear HS2_Correspondence,

RE your response of 2nd May

The recommended ICO guidance is to respond promptly (i.e. within 5 days). It is a legal requirement to respond within 20 working days. Further to this, accurate and timely responses to FOI requests are also a contractual responsibility of the Accounting Officer, as outlined in 8.1 of the Framework Agreement. Failure to respond to respond in a timely manner is a breach of these contractual obligations.

I originally made this request on 9th January. The entirely unreasonable and unexplained delay in responding to this request is unlawful, if not illegal.

Please:
1. Respond to this request immediately.
2. Acknowledge receipt of my second FOI request dated 1st May to release all correspondence relating to the aforementioned FOI (FOI-19-3036).
3. It is a criminal offence under the Act to 'deliberately destroy, hide or alter requested information to prevent it being released'. This unreasonable delay seems to be a clear example of 'hiding' the requested information. Please provide the name of the person appointed to conduct the internal review so I can escalate a complaint to the relevant authorities.

Dear Mr Bird,

Thank you for this response - but you have neglected to provide the details of the exemption for which you wish to apply the public interest test. Please respond immediately with the relevant exemption.

If I may direct you to points 63-65 of the guidance that you helpfully provided (https://ico.org.uk/media/for-organisatio...
"63. As section 10(3) only permits extensions for further consideration of the public interest, the additional time cannot be used to determine whether the exemptions themselves are
engaged.
64. This means that the authority should have identified the relevant exemptions, and satisfied itself that they are applicable, within the initial 20 working day time limit.
65. Any authority claiming an extension will still be obliged to issue a refusal notice explaining which exemption applies and why within 20 working days. This notice must explain that it requires more time to consider the public interest test, and provide an estimate of the date on which a final decision is likely to be made."

With this in mind, I would appreciate being informed immediately of which exemption you are engaging.

The guidance is also clear on the time that an authority should take to respond to requests. 20 working days is described as a 'long stop' which should only happen in 'exceptional' circumstances. In my experience, and from reviewing other FOI requests to HS2 Ltd on whatdotheyknow.com it seems to be routine that requests are dealt with towards the end of, or after, the 20 working day period. This would appear to be in direct contradiction to your assertion that HS2 takes its legal responsibilities with regards to FOI legislation seriously.

In this case, the information in question (which exemption you are considering) should have been provided already. Given that you would be merely correcting an oversight (and given that it should not take longer than a 30 second email) I do not expect to wait longer than 48 hours for a response.

I have great sympathy for you if you are under pressure 'from above' not to release (or to delay the release of) this information, as I fear that this may put you in a position where you are committing a criminal offence.
