Dear Environment Agency,

1) As a CAT1 responder can you advise me if after the 2013/15 flood incident if you considered applying to the traffic commissioner for blue light exemptions for your badges vehicle or specially trained staff?

2) I would like a copy of all documentation relating to blue lights either from your Fleet Services team and your Field Incident Response team including any decisions on why it was or was not progressed.

3) By not granting you blue lights I believe that this is contrary to ECHR legislation specifically under Article 2, Article 3, Article 8 and Protocol 1 Article 1 which as a member state and a public authority you’re not meant to have legislation that conflicts with any of the rights.

4) I not most nicably recently the Traffic Commisioner had a consultation into extending the blue light use, while there are other DEFRA organisations on he list I notice the Environment Agency were not shown as a considered party. Please can you advise if this is a consultation you are aware of and if so why no representation was made?

Enquiry regarding Freedom of Information request - Blue Lights

 

Thank you for your enquiry which was received on 11 December 2018. We
apologise for the delay in our response.

 

We respond to requests under the Freedom of Information Act 2000 and
Environmental Information Regulations 2004.

 

We have responded to each of your points in turn. Where you have asked for
documentation and decisions (point 2) we attach an email discussion as a

1)     As a CAT1 responder can you advise me if after the 2013/15 flood
incident if you considered applying to the traffic commissioner for blue
light exemptions for your badges vehicle or specially trained staff?

 

Our teams have not made any application to the traffic commissioner for
blue light exemptions or trained staff specifically to use them.

 

2)     I would like a copy of all documentation relating to blue lights
either from your Fleet Services team and your Field Incident Response team
including any decisions on why it was or was not progressed.

 

A brief email exchange took place between Deputy Directors and Mangers
from our Operations, Incident Management and Field Services in June 2018
following an internal enquiry from our Yorkshire Area. This email exchange
is attached (file: 180615 email SW et al_ RE Alteration to Road Traffic
Regulations - Blue Lights).

 

3)     By not granting you blue lights I believe that this is contrary to
ECHR legislation specifically under Article 2, Article 3, Article 8 and
Protocol 1 Article 1 which as a member state and a public authority you’re
not meant to have legislation that conflicts with any of the rights.

 

As no request for blue light exemptions has been submitted, it is not
possible to respond to this statement.

 

4)     I note recently the Traffic Commissioner had a consultation into
extending the blue light use, while there are other DEFRA organisations on
the list I notice the Environment Agency were not shown as a considered
party. Please can you advise if this is a consultation you are aware of
and if so why no representation was made?

 

We have no record of a consultation from the Traffic Commissioners for
Great Britain.
