I am writing to request an internal review of Southwark Borough Council's handling of my FOI request 'Blue Badge Holder Demographics in Southwark'.

The reason given for being unable to process the request is "we do not hold information on the addresses of applicants as statistical data and it is not in a format which would allow us to readily report on the data as requested. In order to collate data on addresses we would need to manually interrogate over 18,900 files at a minimum of three to five minutes per file."

I understand the council has an electronic register of the blue badges it has issued and the person and the address to which each blue badge is issued. Surely somebody in the IT team is able to export the data to Excel and run a pivot table report which would take minutes rather than hours?

Our response:

 

Having considered your request in relation to this query we have estimated
that it will cost more than the appropriate limit to consider your request
as it is currently worded. Your request would breach the appropriate limit
to answer as we do not hold information on the addresses of applicants as
statistical data and it is not in a format which would allow us to readily
report on the data as requested. In order to collate data on addresses we
would need to manually interrogate over 18,900 files at a minimum of three
to five minutes per file.

 

The appropriate limit is specified in regulations and for local government
is set at £450. This represents the estimated cost of one person spending
18 hours in determining whether we hold the information, and locating,
retrieving and extracting the information. Consequently, we are not
obliged by the Freedom of Information Act 2000 to respond to your request
(see section 12(1)).

Our Internal Review response:

 

Thank you for bringing this matter to my attention. I have reviewed the
original response taking into consideration the ICO guidelines on
responses that receive a section 12 (1) exemption. In our response our
officer has clearly indicated that the Council does not hold the
information in the format request and to be ale to supply a response would
involve the checking of over 18,900 records to locate and extract the
information requested. The Officer and the service have estimated that
such process would take between 3-5 minutes per record. Consequently this
would exceed the appropriate limit of £450 applied to local government
(estimated cost of one officer spending 18 hours ).

 

In our response to this information request our officer has clearly
indicated that to check through all records to provide the information
exceeds the appropriate limit and the Council is not obliged to comply
with the request. The officer further explained that we also have a duty
to indicate if a request can be modified in any way that would reduce the
time/cost needed to reply and has suggested a way in which this may occur,
however also warning that a re-submitted and changed information request
may still receive a section 12 (1).

 

We conclude therefore that our Officer has correctly responded as required
under the Freedom of Information Act 2000.

 

If you are not content with the outcome of your appeal you may apply
directly the Information Commissioner for a decision. You should contact
her within 2 months of the outcome of your internal review appeal.
