Please inform me whether or not you hold the information specified below, and if you do please send me a copy.

In respect of Black, Asian, Minority Ethnic (BAME) service users who, due to having specific problematic experiences relating to their ethnic or cultural identity, or due to their experience of racism, find it difficult in communicating with and also accessing your services I am requesting a copy of the recorded information you hold of what:-

Are the specific issues that BAME service users (as described above) experience that makes it difficult for them to communicate with and also access your services.

Are the needs of BAME service users (as described above) to enable them to communicate with and also access your services.

Provision has been made in respect of the needs of BAME service users (as described above) to enable them to communicate with and also access your services.

4. I am also requesting a copy of the recorded information you hold which details the training your medical staff have had in respect of the assessment of:-
The effects of racism upon the mental well-being of BAME individuals.
The effects of ethnic isolation upon the mental well-being of BAME individuals. **

I do not require any information about translation services or matters relating to BAME’s who have language issues.

** By Ethnic isolation I am referring to non-white BAME’s being brought up and/or living in communities and/or families that are substantially white and where there is almost no meaningful contact and interaction with other BAME’s of a similar ethnic background.

Thank you for your 27/02/18 response following my complaint to the Information Commissioner.

Please respond via this website as I wish this FOI to be in the public domain.

To assist you;
My request was based on the fact that your organisation’s years of responsibilities and learning would ensure you hold information fitting criteria of my FOI request as a result of, for example:-

*) Massive amount of publications, covering the issues of my FOI, published by, and/or relevant for, NHS bodies. Delivering Race Equality, for example, recommended actions which would ensure processing of information fitting criteria of my request and, despite the time span, such actions (racism training for example) remain relevant.
*) Equality and Human Rights Commissions Triennial Reviews, Public Health England, NHS England, Department of Health and Care Quality Commission publications all refer to issues I have requested information of in my FOI request.
*) Many years of Hate Incident/Crimes reported in Police reports and also local and national media which should be used to inform service provision.
*) Equality duties; your ‘due regard’ and ‘anticipatory’ duty would ensure you processing relevant information. Years of relevant publications evidence racism can cause disabling mental health issues and also impair access to services- for example the well documented impact of the fear and stigma (caused by racism); ‘ Stigma and fear can stop people (and people from black and minority ethnic communities in particular) seeking help at an early stage for their mental health problems.73’ Wigan Joint Strategic Needs Assessment 2011 Mental Health and Wellbeing.
*) Ethnicity of the population of the area you cover which makes ethnic isolation a must address issue, as confirmed by a NHS England publication stating the harm of ethnic isolation.
*) Your correspondence with local NHS bodies in which you say you constantly improve your services as a result of learning from BAME individuals/service users of the racist incidents they have experienced.
*) Your handling of Black, Asian, Minority Ethnic (BAME) service user’s complaints; lessons learned and recommendations.

The first paragraph (below) of my 28/11/16 FOI was copied from a 2009/10 (09/1302) Investigation Report, of BAME service user’s Complaint, by investigating officer Dr R.P. consultant clinical psychologist which stated;
‘3. in the wider context this complaint has thrown up a systemic issue that service users from ethic minority backgrounds for whom it is identified from the onset or during assessment that there are specific problematic experiences relating to their ethnic or cultural identity, or due to racism, that they should be offered the choice to see practitioner from a similar ethnic background, which may need to be from a different part of the Trust, if not available locally. The Trust would need to develop systems to support and validate the specialist expertise of those required to deliver these specific duties. There would also need to be performance management indicators to measure outcomes around this work.’
Statements by Chief Executive Mr Simon Barber and Ms G.P.L. Equality and Diversity Advisor, in respect of BAME service user’s Complaints also support above evidence that your organisation will, on the balance of probabilities, hold information fitting criteria of my request.

So, regarding my 28/11/16 FOI requests (copied below) I am simply requesting copies of information you hold about the matters that I have clearly described and that your organisation must be very much aware of for reasons explained above.

My 28/11/16 FOI stated;
‘ In respect of Black, Asian, Minority Ethnic (BAME) service users who, due to having specific problematic experiences relating to their ethnic or cultural identity, or due to their experience of racism, find it difficult in communicating with and also accessing your services I am requesting a copy of the recorded information you hold of what:-

As such, I asked our Integrated Governance Team to review your original request and outline what they believe you are requesting.
