Bit-for-bit copies of digital photos of adverts on land adjacent to 18 Wind Street Ammanford (Smart Parking)
Dear Carmarthenshire Council,
Your Council began enforcement action against Smart Parking Ltd, operating a paid for car park on land adjacent to 18 Wind Street Ammanford (commonly referred to as Shoppers World car park) in early August 2019 (E/ENF/09368).
A complaint had been made that Smart Parking Ltd were in breach of s224 of the Town & Country Planning Act, not holding valid planning consent for advertisements over 0.3m^2. Guidance is available on the Welsh Government website. This is the law, rather than an offer to enter into a commercial contract. pg27 of the Advertisement Control booklet (prepared for DfT & Welsh Ass for Wales) provides a useful summary of fines (£1,000 at time of publication) for Illegal advertisements - Newport Council have a copy conveniently linked on their Planning site. The Council has since confirmed that no such planning consent was/is currently held.
Please provide digital copies in the native format exported from the camera(s) of the photographs that your enforcement officers took of all the signage found in the car park on all the visits that they have made since August 2019.
For clarity, since we are dealing with a digital source by "copy" I mean a bit-for-bit likeness of the file transferred from the camera(s). The images should not be transcoded into any other format, nor should the resolution, colour balance, timestamp nor any other element encoded in the EXIF header be changed (save where the file's access time is written back to the file as a function of the operating system) . The Council will of course have stored such files safely, in line with the Council's published retention policy.
Since the Enforcement team have recently used these images to form low resolution composites then I hope it won't take too long to find and disclose the recorded information .
