CLARIFICATION REQUIRED

I am writing to ask you to clarify your request. This is because we need further details from you in order to identify and locate the information.

Therefore I should be grateful if you would clarify what search you would like us to carry out in relation to this request, as there are a number of ways that we can search for this type of information.
1.We could search the MO Notes for “Jewellery”.
2.We could use the “Jewellery” filter on the “Product Category Description”.
3.We could search for the word “Jeweller” within the “Premise Name” to see what results are brought back.

The above searches bring back slightly different results so we need clarity on what data you are trying to retrieve.

Please contact me if you need assistance with this.

To enable us to proceed with your request I would be grateful if you could provide the clarification outlined above within 40 working days of this correspondence. After receiving your reply, your request will be considered and you will receive a response within the statutory timescale of 20 working days, as defined by the Act, subject to the application of any statutory exemptions. Dear Mr Hunter

FOI Request Reference: 572A/21

Thank you for your request for information, received 07/04/2021 and
clarified on 16/04/2021.

REQUEST

I’d like to request information on Jewellery that has been reported as
stolen;

1) The amount of cases of reported stolen jewellery, across all theft
offence types.

2) If known, the total value of all jewellery that has been stolen.

I’m looking for information specifically within the area of Birmingham,
Coventry, Wolverhampton.

If I could please receive these for 2018, 2019, 2020 that would be
fantastic.

CLARIFICATION

I believe the option of the Jewellery filter on the Product Category
Description would be best fitting according to the information I am
seeking.

RESPONSE

Our data are not organised in such a way as to allow us to provide this
information within the appropriate (cost) limit within the Freedom of
Information (FOI) Act (see ‘Reason for Decision’ below).

Although excess cost removes the force’s obligations under the Freedom of
Information Act, as a gesture of goodwill I have supplied information,
relative to your request, retrieved before it was realised that the fees
limit would be exceeded (see attached). I trust this is helpful, but it
does not affect our legal right to rely on the fees regulations for the
remainder of the request.

REASON FOR DECISION

Please note that researching each individual case would exceed the
appropriate limit (FOIA, s.12).  It would not be possible to read through
the MO Notes of each offence to find the value of the goods stolen, as
this would require a manual search of all records and would exceed the FOI
time limit.

Also please note we have conducted the search as requested, however in
order to be 100% accurate that all the results relate to ‘jewellery’ would
again require a manual review of each record.

The cost of compliance with the whole of your request is above the amount
to which we are legally required to respond, i.e. the cost of locating and
retrieving the information would exceed the appropriate costs limit under
section 12(1) of the FOI Act 2000. For West Midlands Police, the
appropriate limit is set at £450, as prescribed by the Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004, S.I. 3244.

Further information on section 12 of FOI is available here:

RIGHT OF APPEAL

Your attention is drawn to your right to request a re-examination of your
case under West Midlands Police review procedure, which can be found at:

[2]http://foi.west-midlands.police.uk/revie...

Please note that such an appeal must be received within 40 working days of
the date of this correspondence. Any such request received after this time
will only be considered at the discretion of the FOI Unit.

If you require any further information, then please do not hesitate to
contact me.

Yours sincerely,

Andrea Mobberley
