Dear Shankar Lakshmi,
 
Freedom of Information Act 2000
 
Many thanks for your e-mail in which you raise a concern that we have not
released the information as part of your initial request. We have looked
at this and decided to maintain our previous decision to withhold some of
the information you requested previously. Under Section 40 of the Freedom
of Information Act, subsection 2, we are not obligated to provide
information that is the personal information of another person if
releasing it would breach any of the provisions in the Data Protection Act
2018. In this instance, I believe that releasing all the information you
have requested would contravene the first principle (a) of the Act because
it would not be fair on some of the pupils who sat the test because it
could allow them to be identified. Section 40 grants an absolute exemption
on disclosure, which means we do not have to consider the public interest
test in this instance.

Whilst we appreciate that this information was provided last year the
London Borough of Bexley has decided to change the information which is
made available following concerns raised by a parent that the Selection
Test data we published/released could result in their child being
identified.
