1 Best interest policy referred to and used in all dealings with best interest MCA ?
2 that also includes documents used and referred to by the CSU contracted services to the CCG that ensures the upholding of the best interest legal framework
3 Where does the CCG and CSU get its guidance from when implementing best interest legal framework of the MCA and may I have a copy of that guidance (excluding the MCA itself and its practitioners guidance)

From the response it seems clear that 7 years after the implementation of the Mental Capacity Act an implementation that was funded by the DH - Wandsworth Council and the CCG/CSU do not seem to have any Best Interest Policy or it seems guidance to staff on how to comply with Best interest legal framework re the MCA nor any best practice guidance for staff or service users and may not be proactively upholding persons rights that they are duty bound to do for all but especially for those who lack capacity under this Act and within that legal framework and are subjected to processes that can ignore/neglect their rights.

Persons who lack capacity rely on the authorities to proactively uphold their rights under the Act and many may be disadvantaged and subjected to processes without being able to exercise their rights and without protection of those rights and rely on the authorities to do this. This seems to be a failing on the part of the authorities that is almost impossible to get rectified or rights complied with and little redress regarding these failings for service users.
