Does this mean they failed or withheld information the first time the same questions were asked or was it down to the questions being worded differently?

They are very precise about how the questions are worded so I believe this helped - you can also see the history of the communication on http://blog.szlwzl.com. I will also upload the email requesting the review which asked me which sections I would like to consider:

1) conduct an internal review of the BBC's application of Section 42 (legal professional privilege exemption) to the information located but withheld under the request

2) conduct an internal review of the BBC's decision that no information, other than information subject to legal professional privilege (and withheld under Section 42) was held by the BBC

3) conduct an internal review of both 1) and 2) above

I chose 1, I'm pretty certain 2 would not have brought back any information and 3 would have been rejected as taking too long. I have also submitted another FOI request(http://www.whatdotheyknow.com/request/be...) to ask for more information. I have asked a question on the thread(http://www.bbc.co.uk/blogs/bbcinternet/2...) about how beebplayer broke the terms & conditions and will follow this up with FOI if they don't answer to my satisfaction.
