BBC/TV Licensing Communications with Google

The request was partially successful.

Dear British Broadcasting Corporation,

I am making this request for information under the terms of the Freedom of Information Act 2000.

When browsing YouTube recently it became apparent that several videos critical of the BBC and/or TV Licensing had been removed because the content "Violated YouTube's Terms of Service".

Please provide copies of all communications relating to YouTube, Blogger or Google Search content between the BBC/TV Licensing and Google since 2005. This includes copies of emails sent to Google by BBC/TV Licensing employees.

Section 11 of the 2000 Act allows the applicant to express a preference for the delivery format of the response, which the public authority should make every effort to comply with.

In this case I wish all response documents to be delivered in electronic format to the return email address associated with this request.

I look forward to a timely and complete disclosure, in accordance with the spirit of the Act.

Yours faithfully,

Peter Jones

Dear FOI Enquiries,

Please note my request for an internal review of my previous FOIA request "BBC/TV Licensing Communications with Google" (RFI20111295).

Having taken time to reflect on the BBC's response to that request I consider it extremely unlikely that Google would have censored web content at the behest of a private commercial body like Capita.

From my own experience I know that Google is often unconcerned with the wishes or opinions of private individuals or organisations, unless there is some sort of legal motivation for them (Google) to act.

It is my opinion that Google would have only acted if Capita requested web censorship under the guise/authority of "TV Licensing" or "the BBC", which squarely brings my request for information back into validity. To that end I consider it likely documents do exist that should have been disclosed by the BBC in response to my request.

I am also mindful of the fact that the BBC has provided unsatisfactory responses to several of my previous FOIA requests, which they have subsequently "clarified" when pressed on the issue.

I look forward to your review findings.

Yours sincerely,

Peter Jones

Dear FOI Enquiries,

It is now more than 30 working days since I requested an internal review (IR2012002) and I have heard nothing.

Whilst I appreciate there is no statutory time limit for providing a review response, I would have expected the BBC to deal with my request in a timely manner.

Please give an indication of how much longer I can expect to wait.

Yours sincerely,

Peter Jones
