If the current contract differs from an earlier one, please supply both.

RE: Request for Information – RFI20151851

Dear FOI Enquiries,

My very short and simple request was for the CURRENT contract. Your subsequent reply bafflingly bases itself upon section 21 of the Act (information freely available elsewhere) and linking to what you go on to reveal is an old version of the contract in question anyway. To add to the absurdity of this, my simple-to-understand 4 line request specifically closed with:

"If the current contract differs from an earlier one, please supply
both."

So in order to keep things nice and easy, let's say the link you provided was to the 'earlier one'. I would now like, as requested, the 'current contract', OK?

If you were happy to comply with FOI law by supplying a copy of the contract as it stood in April 2014, I am puzzled as to why it would somehow be exempt now, due solely to a few tweaks since made here and there to its terms. I am sure I needn't have to remind you that names and addresses etc. can be redacted if needed.

I'm afraid if it is not already in the public domain, BBC/Capita will now not answer ANY valid FOI questions. But use one of their excuses, usually the "It may help evaders/lawbreakers" or "it will take longer & cost more than the prescribed cost/time" excuses.

This is not complying with the Freedom of information act at all, but they continue to get away with it.

Thank you for your email, as explained in our letter to you on 1 December, we are still considering whether or not we can disclose to you elements of the current contract with Capita because there have been changes since the version we last considered (and to which you were signposted under section 21 of the Act). We are expecting to have considered what further we can provide to you by 4 January 2016.

You request, RFI20151851, hasn't been closed, it is on hold while we review the information held. We will therefore not be logging your request below. We will contact you again as soon as possible.

They certainly weren't happy to provide the initial contract. I seem to remember they dragged their feet for as long as possible and made life as awkward as possible for the applicant, before they were forced to disclose the information.

Using BBC logic they probably think they can do the same with you.

Naive of me possibly, but I have trouble coping with the notion of public sector and public-paid employees whose job description is providing information freely, who appear to spend time individually and one presumes in meetings mainly concocting ever more unique ways to not do so.

The BBC must really hate the FOI act, though they do use it themselves (& crow about it if they succeed) to get info out of "Other public bodies" Lots of hypocrisy at the BBC

At first glance it would appear that you have done your very best to answer my request.

At the present time, however, I haven't read your reply attachments because they appear to be scanned either sideways, or upside down.

I wonder if you would would be kind enough to re-submit your attachments in such a way as to be easily openable/readable to those of us that don't have the IT skills to flip, rotate or reformat documents such as those you have provided.

Dear FOI Enquiries,

Your recent lapse in communication aside, I apologise for the delay in writing this- my attention has been diverted elsewhere this festive period.

Documents that you have provided appear to be scanned sheets of A4 paper, signed in pen, which appear to include hyper-links to Word documents that are pertinent to my request (and your subsequent response). I wonder if you would be so kind as to help explain how I can access these, as they don't seem to open if left-clicked from either the on-screen image scan or, even, on real paper (post-print).

Please humour me in my ignorance, having been previously unaware of new technology enabling the inclusion of hyper-links on A4 paper documents or, indeed, paper documents of any other size.

In reference to my previous post-response query- I would appreciate it if you would do better than to leave it to other users of 'What Do They Know' to provide answers to sought clarifications which I have addressed to yourselves.
