Dear Jill Yeovil,
Freedom of Information Act 2000 – Request for Information
I am writing in respect of your request for information held by the
Authority under the provisions of the Freedom of Information Act 2000 –
Reference FOI 1375
On identifying the information requested it has become necessary to
consider applying the public interest test as we consider that the
information you have requested may be subject to exemptions from
disclosure under S43 of the Act.
Section 43 FOIA provides in material part as follows:
“43 Commercial interests.
(1)Information is exempt information if it constitutes a trade secret.
(2)Information is exempt information if its disclosure under this Act
would, or would be likely to, prejudice the commercial interests of any
person (including the public authority holding it)..."
The Authority needs to balance the public interest in disclosing the
information against the public interest in withholding the information
from publication.
In order to carry out this legal work, the Freedom of Information Act
allows Birmingham City Council, as a public authority, a further
reasonable amount of time. This request has therefore been passed to our
legal team to apply a public interest test to this request.
Birmingham City Council will endeavour to forward a response in relation
to the information sought subject to the public interest test by no later
than 23^rd December 2015 (20 working days from original deadline).
However, it may be that due to additional circumstances, this limit may
need to be extended. If this is the case, you will be notified before the
above date, with the reasons for the delay.
Regards.
