Hi Rebecca,

I would like to be as helpful as possible on this - and we had some debate internally about the level of redaction that would be needed on individual names etc to share the related information before concluding that we couldn't do it within 18 hours.

We don't have a digital copy of the report. We can photocopy it and send through the post but that would mean a charge of 50p per page x 149 pages. The only copies we hold are in a hard format in the archive. I appreciate this doesn't help you enormously but it does seem a visit to our archives or the British Library is only the option.

I have received your reply, at which I am appalled.

I too would like Hackney Borough Council to be as helpful as they can on this as well but the situation we are in now is that 4 months have gone by since my legitimate request and Hackney Borough Council are still prevaricating, having already failed to comply with the law. I have been excessively patient so far.

Furthermore Hackney Borough Council are prevaricating over, as far as I can tell over a very comparatively tiny amount of money for the council WHEN Hackney Borough Council have been criticised in this very report that I am asking for, for failing to suspend someone who went on to commit more sexual abuse, against children.

CHILD SEXUAL ABUSE, HACKNEY COUNCILS FAULT AND YOU ARE ARGUING ABOUT A FEW QUID? Please think about that.

Do you not think that that amount of money is money well spent (not that it is money anyway , merely time for your employees) in carrying out your duty of care to the people abused who should have been cared for properly by Hackney Borough Council in the first place? So that now at last they can begin to learn the truth and start the healing process?

How do you think the victims feel when they see what Hackney is doing after having caused their suffering?

BUT to top it all, Hackney cannot by law, even charge redaction fees to me, so Hackney Councils reasons for not sending it to me are invalid.

Please could you send me the report, in digital format, by email to this address, redacted if necessary, as soon as possible and I would advise you to consider it money well spent in your duty to try and alleviate the horrible suffering that Hackney Borough Council have caused, suffering that can never be taken away, merely eased.

If the Council or any of its employees had anything about them they would recognise that they have a duty to the victims to publish this also in your publication scheme so it is available on your website

Hi Rebecca,

I do appreciate your frustrations on this matter.

To clarify, the report itself is already in the public domain - via our
archives or the British Library - and can be viewed by anyone without
redactions. It is only the associated information which has been
exempted under section 12 of the FOI act. Given the report was published
in 1997 I understand it wasn't typical practice at the team to make
digital copies, hence it was never converted into this format. Like many
other public bodies we find ourselves delivering essential services in
the face of shrinking resources. Unfortunately for this reason we are
unable to spare the resource to scan such a large document.

I acknowledge your concerns however about both the validity of this
response and the length of time it took. With that in mind I have
forwarded your email to our Information Management Team who will conduct
an internal review, as per the process outlined in my original letter to
you.

I do not think you do understand my frustrations on this matter, partly because you fail to understand the FOI laws.
Further I do not agree with calling an internal review yet. If I wish to call an internal review, I will do it my own time and will have prepared the reasoned arguments first rather than react to your time schedule.
You are free to do what you wish, but I am reserving my full rights independent of your internal review if you are calling it.
The law for your information is not whether it is publically available but whether it is reasonably accessible to me, which I am telling you it is not.
I ask you once again to scan 150 pages and I do not think this will impact adversely on the rest of your essential services.
Under s16 how long do you think that scanning 150 pages will take?

As regards the Report itself, you have not detailed which section you are refusing it on. However I hope this is not necessary as you will send me the electronic report.

On the other information which you state is not in an easily accessible format and refusing under section 12, please could you give a detailed breakdown of the estimation, and I ask for advice under s16 on how my request can be brought within the cost limits (eg electronic only records, or a particular time period, or those from a particular department etc). On this "other" information please advise on the basis of a separate request, more than 60 days after the last request.

Further to my email of 29th April asking for my question of 15th Feb to be answered, and of course the outstanding documents, I would like an update on the urgent enquiries of 30th April, of
which I have not heard yet.

Please could you also State whether Hackney Council owns the Copyright to the Hackney Barratt report and what information is available on who does?

Hi Rebecca,

I note with alarm that you've been waiting over five and half months for your questions to be answered and over three months since you asked for an internal review.

It appears that the Chief Officer allocated to your case has failed to do their duty.

Hackney Council advises, on its own website:
"What happens if I'm not happy?"

If you feel that your request has not been handled well, you do not agree that the information will be exempt, or you disagree with the suggested cost of providing the information, you can request an Internal Review of the original decision. Details of how to appeal will be provided with any response to your request.

A Chief Officer will review your case to ensure that the officers dealing with the original request have done so in line with the requirements of the legislation. If they decide that information should not be exempt then it will be released.

If you are not satisfied with this decision you can complain to the Information Commissioner (see below) who is independent of the Council.
