Dear British Broadcasting Corporation,

May I start by making you aware that I am both physically and mentally disabled, a vulnerable adult with a mental health injury , and therefore ask for a ' reasonable adjustment ' for the information I am requesting to be provided in written form to answer the questions I am putting to you, and on a memory stick for the broadcasted content of the programme I am asking about , that I took part in and was broadcast on BBC Wiltshire Radio on Thursday 02 ,March 2017 between 09.00am and 12.00 midday on the Shaun Hodgetts radio programme.

May I please have a copy of the programme as it was broadcast on memory stick .

Just after 11am, the presenter stated " by the end of next week we will have answers to the questions for you " ( Jane Scott had agreed during the programme to update the presenter on the actions she had taken within one week ). May I please have on the memory stick, the update and answers to the questions that had been put to Jane Scott and a description of the actions she had taken ?

I have attempted to speak with Shaun Hodgetts several times over the past 4 weeks since broadcast , but without any response .

Hence if BBC Wiltshire radio has any record of its attempts to contact Jane Scott or the Council to obtain the ' answers ' or other information relating to this programme, I would like to see here please all of the documents showing the BBCs efforts to obtain the information they were expecting to broadcast at the end of the week, and of course the documents or any records held relating to the responses given by Jane Scott or Wiltshire Council.

Your staff at BBC Wiltshire Radio took my home address & telephone number on the day of the broadcast to also be given to Jane Scott before she left Wiltshire Radio offices, so I trust you hold my address and postcode to send the memory stick.

I am sorry you choose NOT to assist me by providing the information I have asked for , and have also chosen to ignore my request under the Equality and Disability Discrimination Act for a ' Reasonable Adjustment '

I am further sorry you have not allowed any discretion to provide this information under the Right to know,
have also stated " The BBC does not offer an internal review " - all very distressing for me.

May I AGAIN ask you, in light of my disabilities identified within the first paragraph of my request dated 30 th March 2017 to provide me with a ' reasonable adjustment ', and please forward my original request through the contributor access route that you mention , and explain to me why you did not just do this so I could gain access to the information I am seeking ?

Would you be kind enough to confirm or deny if the ' contributor access route ' would also provide me with the information requested in para 4 commencing " I have attempted to speak with Shaun Hodgetts..... ",
and paragraph 5 commencing " Hence if BBC Wiltshire radio has any record ......... " , if that department will not provide that information please advise me on how to obtain it.

Dear Mr King,

 

We are sorry you are not happy with our response to your recent FOI
request however we understood your Reasonable Adjustment request to be for
the information to be provided in written form to answer the questions you
asked. We responded in writing to you on 4 April 2017.

 

With regards to providing a copy of the broadcast on a memory stick, as
explained this can be obtained through the contributor access route. The
BBC cannot make this request on your behalf and the form needs to be
completed by the individual (however relatives may make a request on the
subject's behalf). There is also a fee for copies and as such this will
need to be provided by the individual.

With regard to your request asking for documents or any records relating
to the programme this information is held for the purpose of journalism,
art or literature and as such is not subject to the FOI Act. Part VI of
Schedule 1 to FOIA provides that information held by the BBC is only
covered by the Act if it is held for ‘purposes other than those of
journalism, art or literature”.  The BBC is not required to supply
information held for the purposes of creating the BBC’s output or
information that supports and is closely associated with these creative
activities.

 

If you disagree with our decision you can appeal to the Information
Commissioner.

I am sorry to have received such an unhelpful response from you the BBC.

Due to my long term disabilities and ill health, I am unable to afford the substantial costs
you are insisting I must pay before receiving the information I have asked for.

I believe that you also place strict restrictions on the use of any recording I may ask for
or receive, that would prevent me from sharing it with The House of Lords or Wiltshire Council
as I wish to make complaints to both regarding Baroness Jane Scott of Bybrook OBE, Leader of
Wiltshire Council who I spoke with during the broadcast of this programme.

I have been advised to make another request to you, which I shall do today.
