Dear Ministry of Justice,

It is a known fact that the MOJ bankrolls the CCRC yet the CCRC is meant to be an independent body looking at corruption and injustice that the MOJ commits. There is obviously a conflict of interest if the two bodies are intertwined so why can this be justified?

Is it a case of the MOJ having a hand in deciding what cases the CCRC investigate actually do get referred for appeal?

Just to clarify, i am allowed to put my FOI request in the form of a question.

Thank you for your email of 30 January sent to the Data Access & Compliance Unit. Your email has been forwarded to HM Courts & Tribunals Service (HMCTS) to reply as your enquiry does not fall under the Freedom of Information regime and has therefore been treated by this department as 'Official Correspondence'. It may be helpful if I explain that the Freedom of Information Act (2000) gives individuals and organisations the right of access to all types of recorded information held, at the time the request is received, by public authorities such as the Ministry of Justice (MoJ). Section 84 of the Act states that in order for a request for information to be handled as a Freedom of Information (FOI) request, it must be for recorded information. For example, a Freedom of Information request would be for a copy of a policy, rather than an explanation as to why we have that policy in place. On occasion, the Ministry of Justice receives requests that do not ask for recorded information, but ask more general questions about, for example, a policy, opinion or a decision.

The Criminal Cases Review Commission (CCRC) independently investigates alleged miscarriages of justice. Further information on the work of the CCRC, it's funding and the basis on which it will independently review cases can be viewed on it's website at the following address: http://www.ccrc.gov.uk/.

HMCTS is an executive agency of the Ministry of Justice and is independent of the CCRC. You can find more information about the work HMCTS does and it's funding on the GOV.UK website.

If you do have any concerns about a case that has gone to the CCRC, you may wish to seek independent advice.

There is nothing further I can usefully add to my reply below.

You may wish to contact the CCRC for further information on their funding.

I must ensure that tax payers' money is used effectively. For this reason and in line with HM Courts & Tribunals Services' procedures, we will not be replying again unless you raise new issues. This will also apply to any letters sent to named government officials such as the Prime Minister which are passed to this department for response. Any letters which raise new issues will of course be answered in the normal way.

Typical response from a corrupt branch of a corrrupt government. There is nothing uselful you can add because it is beyond you to tell the truth and be open and honest. I now request an internal review before i take the matter to the ICO.

You do not need to explain the FOI act as i am fully aware of it. Let me be clear here. I am not asking for personal information. If i was i would submit a SAR. I am not. The questions i have asked above are not personal ones. They are general questions regarding the funding of the CCRC by the MOJ. Please answer.
