Banham Report

Here is some information from the Waterhouse report

15.42 In November 1990, after Norris' conviction and sentence on the first indictment brought against him[243], Clwyd County Council instructedJohn F Banham, a retired senior officer of Cheshire Social Services Department, to act as an independent reviewing officer on its behalf and to present a report into the events at and around Cartrefle Children's Home when residents were victims of sexual abuse. The Clwyd Area Child Protection Committee was informed of this initiative and decided to call for agency case reviews from the Health Authority and the Education Department in an attempt to conform with procedures recommended in Part Nine of Working Together (1988)[244] . The review on behalf of the Health Authority was carried out by Dr Kathleen Dalzell and that on behalf of the Education Department by David Lund, Co-ordinator of Support Services. The three reports were presented by June 1991 and the Clwyd ACPC then appointed an independent panel of inquiry of five senior professionals to provide an overview, envisaging that four days at the beginning of July would be required to carry out their terms of reference. A robust response was given to this time estimate and the panel's own report was presented in February 1992 or soon thereafter.

15.43 The Banham report and the panel's own report of its overview of the three reports that it considered together form a strong indictment of the regime at Cartrefle and of its management, both internally and externally. The panel's report extended to 39 pages, excluding its appendices, and the Banham report to 32 pages so that it is impracticable here even to summarise them in great detail. It is, however, necessary to refer to the most striking and relevant points that emerged from them.

Firstly I would like to assure you that the Council is committed to
providing copies of the requested information, however as you will
appreciate the reports contain highly sensitive information. Consequently
the Council has engaged specialist legal advice on how to handle your
request and we are currently working through the advice given. This is an
extremely time consuming process so we do ask for your patience in this
matter. It is likely that the reports will need redacting which again will
take time. It is also our intention to consult with colleagues from
Operation Pallial and the Independent Inquiry into Child Sex Abuse prior
to releasing the information. This is to ensure that the Council does not
inadvertently harm any ongoing investigations that Council officers are
not privy to, defame any individuals named in the reports or accidently
release the details of victims.

 

You may be aware that a council can take longer to answer certain queries
under the Freedom of Information Act where it must balance the public
interest on whether to disclose information.  Guidance from the ICO makes
it clear that such an extension may only be used in exceptional
circumstances Given the need for independent legal advice and the
complexity of the issues to be balanced I would say that exceptional
circumstances apply.   

 

I also acknowledge that the Council has failed to keep you sufficiently
informed of progress therefore I would like to apologise on behalf of the
Council. I would however like to re-iterate that I found no evidence that
the Council is deliberately withholding the reports and there is a clear
commitment from the highest level of the Council to release the reports
following this process of due diligence, as ultimately happened with the
Jillings report (where similar complex considerations applied).

 

Waterhouse was a Department of Health public inquiry and its publication
was nothing to do with Flintshire County Council – in fact it was only
called due to Clwyd’s refusal to publish its own enquiries such as the
Banham report.

Dear Alun Kime,

Thank you for your quick reply. I am unsure if the reply was an update or meant to be an internal review, perhaps you could say.

The Council has given me no information in 6 months, jsut the odd holding reply and has not even tried to answer the request as per the FOI Act. It is is a bit more than "the Council has failed to keep you sufficiently informed of progress"

You are only allowed extra time, if you inform me of such and please do so under the correct FOI section.

Please also tell me by return what documents the council holds as was the Councils Duty to do so under FOI over 5 months ago.

Please tell me when you engaged specialist legal advice. Why was i not told when you engaged it, and why did you not notfify me that you wanted an extension. You havent even started redacting yet, consulted Pallial or IIICSA. What have you been doing?

It beggars belief. What is " working through the advice" - it seems either this is being used as an excuse for doing nothing at all. Who was responsible for "working through it?"

Further to your email dated 28th July 2017, I would like to confirm that my response was in relation to the complaint that you made that your Freedom of Information had not been processed in accordance with the legislation. As advised you have the right to refer the matter to the Information Commissioners Office if you remain dissatisfied with my response.

You have raised a number of follow up issues that I would like to address that will hopefully provide you assurances that although the Council has failed to comply with the timescales for responding to your request, it is taking the appropriate steps to ensure the reports are released without breaching the Data Protection Act or prejudicing any ongoing or future investigations.

I have previously acknowledge that the Council should have handled your request better by properly applying the extension and we should have kept you informed of progress however I can only influence how the request is responded to from now. We will certainly learn from this request and ensure our procedures are improved.

I can confirm that the Council does hold a copy of the Clwyd ACPC Independent Panel Inquiry Report which includes the 'Banham Report', 'Lund Report' and 'Dalzell Report' within its appendices.

The reports were located in May. Unfortunately the reports had not been catalogued therefore the search took longer than anticipated. The legal advice was engaged in June with the advice being received back in July. The reports have now been shared with the IICSA and we are awaiting on a response from the Police after our initial contact.

The Chief Officer Governance has now taken personal responsibility for ensuring that the Council will provide a formal response to your request by the end of September 2017. Whilst I appreciate this may not meet your expectations, I can only re-iterate the complexity of this case means that we have to consult with various stakeholders to ensure the information is released in a responsible manner, future prosecutions are not jeopardised and that we not disclose the identity of victims.

Further to your request for a copy of the ‘Banham’ report, ‘Dalzell’ report, ‘Lund’ report and Clwyd APC Independent Panel of Inquiry Report. I am sorry that a response cannot be sent to you by the end of September 2017 as planned.

The Council’s commitment to publishing the reports remains, subject to advice on timing and what may be published. However, it has concluded that due to the ongoing Police investigation it is unable to release any of the reports at this time. In summary, having liaised with e Police, the Council is concerned that to release the reports might hamper on-going investigations under Operation Pallial and so the Council will withhold the reports until those investigations are concluded. The full reasons for withholding the report are explained in the attached Appendix.

The Council intends to publish the reports once it is satisfied that it can do so without harming the criminal investigations. Your current request for disclosure will be considered again at that time. There is no need to submit a further request.

The timetable for the release will be driven by the police timescales and that at present it is too early for them to be able to give us a precise date. We will therefore review on a monthly basis and we will update her following each review

For further information, we would refer you to the additional sources of information in the public domain. The Waterhouse Inquiry Report is available from the Department of Health website: www.dh.gov.uk and the Law Commission report number 289 (2004) http://lawcommision.justice.gov.uk.

I understand that you have already complained to the ICO regarding the Council’s handling of this request. The ICO has found that the Council did not meet its obligations under FOI and as such instructed the Council to either release the information or issue a refusal notice. As the Police have yet to consider the reports fully then the Council has no option but to issue this refusal notice however remains committed to releasing the reports in the future.

I may have missed it, but i dont think I saw confirmation that the 4 reports were held
Banham Report,
and the review on behalf of the Health Authority by Dr Kathleen Dalzell
and review on behalf of the Education Department by David Lund

Could you give me some information about them , ie the dates and number of pages and full titles.
Could you also tell me if you have made hard and digital copies of them, who now has the originals and if you have an audit trail for each copy of each report.
I mention this as many reports go missing and it is vitally important that the public know what is going on and who has the reports.

I can confirm that the report titles are:

Appendix E - The Dalzell Report. No date on the report. 39 pages in length.

Appendix F - The Lund Report. June 1991. 9 pages in length.

'Ill Groomed for Harm' - A Report of the Management Review for Social Services of Clwyd County Council into the events at and around Cartrefle Childrens Home, Broughton. When Residents were Victims of Sexual Abuse prepared by John F Banham for the Panel of Enquiry. November 1990 to June 1991. 32 pages in length.

A Report of the Panel of Enquiry into events at Cartrefle Childrens Home. Commissioned by Clwyd Area Child Protection Committee. July 1991 - February 1992. 39 pages in length. The above reports are all listed in the appendices of this report.

The reports were held in hard copy by the Council, they have since been scanned and electronic copies are now held. The Council retains the original hard copies. As previously confirmed the Council has shared the reports with the National Crime Agency and the Independent Inquiry into Child Sex Abuse. The purpose of sharing the reports was for the Council to assess your Freedom of Information request.

I have yet to receive a publication date for the above reports, however I will keep you updated.

Thank you for that information that the SIO is Philip Marshall.
Can you tell me if you have asked the police who is refusing to give permission to publish the report and if so have you had this refused? You said you would ask.
This is of course important as the police, and North Wales Police in particular, are widely distrusted due to their history of collusion with child abusers. As the decision to keep the reports hidden could well turn out to be for nefarious purposes eg covering up past police misdeeds, then it is important that there is transparency and that the public have the police public servants name who is responsible for keeping the reports hidden, and that the police are accountable to the public

Dear Cathy,

To clarify I am liaising with the National Crime Agency rather than North Wales Police on this matter. I have not been provided with the name of an individual who ultimately decided to recommend that the Council withholds the reports until the investigations have been. I understand that Investigating Officers and Legal were involved in the decision. I can certainly go back to them to identify if one individual ultimately made the final decision.
