hello
we have rewritten the questions and sent to 50 councils.this will help our review into what is acceptable by bailiffs.we have received prompt responses from over 20 councils .please address in a time you think is appropiate.we realise this may not be completley a foia request but we request with the spirit of equality and ethics that you answer using your code of ethics and yoru contracts with third parties regarding enforcement

under foi or in the public interest can you please answer the following questions...we have had over 20 councils now reply to the same questions within 48 hours .we hope you will do the same

1. Does your enforcement agent contract allow your enforcement agents to issue an
indemnity against prosecution for themselves without the agreement of the council in
cases where they have wrongfully seized and to vulnerable
2. Have you ever allowed bailiffs to make their own settlement agreements where goods
have to be returned?
3. Would you allow enforcement agents to breach the equalities act if it meant your
business rates were collected?
4. How would you react if they did this without you knowing?
5. Would you class a secret indemnity which achieves a gain at the cost to the
vulnerable victim a material breach of contract .?
6. Must enforcement agents always report failed levies and a full report when dealing
with vulnerable customers

Following the merger of Bournemouth, Christchurch and Poole Council’s on
01/04/2019 different procedures were introduced and the email system that
you used has not been monitored but a divert was placed on it to our
enquiries teams for them to process requests. It appears that this divert
failed to pass your message on, even though you received an
auto-acknowledgement your request has not been dealt with and we apologise
for this.

 

We have now passed your request to the relevant Service Unit, we realise
that this will mean a delay to providing a response but please be assured
that action has been taken to respond as soon as possible.
