under foi or in the public interest can you please answer the following.this is not a complaint against you just a general request as to your relationship with enforcement agents.we have had over 20 councils now reply kindly

1. Does your enforcement agent contract allow your enforcement agents to issue an
indemnity against prosecution for themselves without the agreement of the council in
cases where they have wrongfully seized and to vulnerable
2. Have you ever allowed bailiffs to make their own settlement agreements where goods
have to be returned?
3. Would you allow enforcement agents to breach the equalities act if it meant your
business rates were collected.
4. How would you react if they did this without you knowing?
5. Would you class a secret indemnity which achieves a gain at the cost to the
vulnerable victim a material breach of contract .
6. Must enforcement agents always report failed levies and a full report when dealing
with vulnerable customers

facilities and play areas and processing council tax, business rates and
housing benefits. We deal with local planning applications, issue licenses
for taxis and licensed premises, look after parks and open spaces, and
parking around our borough.

 

Please note - services including primary and secondary education, roads,
pavements and street lighting, libraries and adult education, social
services and care, fall outside our service area and are provided by Kent
County Council. If your request falls into one of these categories please

Under a new foia can i ask

Who are your current agents?

Would they answer this under foi on your behalf

Would you ever hide a failed levy from a vulnerable person from the council ?
Would you expect hiding a failed levy or failing to report issues to be gross misconduct?

would you ever obtain a indemnity against prosecution before returning goods from a vulnerable person when you have seized in error or had no choice but to return goods ?a indemnity that covers only you and not the council
would you expect issueing a indemnity and concealing it from the council for ever like this to be gross misconduct and a reason for contract termination.

is there ever a reason for issueing a indemnity consent form to a person under mental health care?

what is your maximum time for holding goods ,sell or return?whats acceptable before it classes as interference?
do you itemise every item on the inventory and include serial numbers if serial numbers are required for ownership?

what is your threshold for someone to prove ownership and value?what checks would you make yourself and how quick would you make those checks or allow the debtor to prove ownership or value ?would a invoice from a supplier showing value of 10 x the debt be enough ?

would you class the loss of 7 jobs for a 2.5k bill excessive ?ie a customer tells you company will go bust if you continue to seize goods not owned by the debtor .how would you check the value of lets say vending machines?do you understand human rights article 1 protocol 1.?

would you ever employ a bailiff who was sacked from his last job for gross misconduct ie theft .if he was self employed how would you check ?as well as a certificate check would you always do a background check with references into self employed bailiffs
