Bailiff indemnities

We're waiting for steve to read a recent response and update the status.

Dear Bury Metropolitan Borough Council,

under foi or in the public interest can you please answer the following.this is not a complaint against you just a general request as to your relationship with enforcement agents.we have had over 20 councils now reply kindly

1. Does your enforcement agent contract allow your enforcement agents to issue an
indemnity against prosecution for themselves without the agreement of the council in
cases where they have wrongfully seized and to vulnerable
2. Have you ever allowed bailiffs to make their own settlement agreements where goods
have to be returned?
3. Would you allow enforcement agents to breach the equalities act if it meant your
business rates were collected.
4. How would you react if they did this without you knowing?
5. Would you class a secret indemnity which achieves a gain at the cost to the
vulnerable victim a material breach of contract .
6. Must enforcement agents always report failed levies and a full report when dealing
with vulnerable customers

most unusual considering the 70 pus replies we have had from other councils

if a enforcement agent took goods worth approx800k to a customer for a 2k rates bill in error then because he was forced to return the goods due to the threat of a injunction are you ok with him getting himself a indemnity against prosecution despite the fact it has put someone in a mental hospital and has cost 7 jobs?
hope this gives more clarity to what we mean by a secret indemnity.in your contract therefore you allow ea to do their own deals withotu authourisation from the council even when they have caused huge damage

                Sincere apologies with the delay with response regarding
your further request for clarification, I have been awaiting confirmation
from our acting Head Of Service, Ian Davenport on this matter. Please see
his response below :

 

I can confirm that the Council expects all of its contracts to be complied
with and that we do not expect any of our suppliers to attempt to
circumvent the contents of those contracts or to work in any way that is
not compatible with the contract.

In reference to your question regarding “secret indemnities” we would
regard this as incompatible with our contract.
