Bailiff fees unpaid by debtor for council tax recovery
Dear Uttlesford District Council,
In cases allocated to bailiffs for collection of council tax; do Uttlesford District Council pay the bailiff their fees for work carried out by them when the debtor does not because of direct settlement of the account with the authority?
If compensation to bailiffs is paid by the council due to debtors not paying bailiffs their fees; what are the annual figures for the years 2002 to date with respect to this payment?
Yours faithfully,
Neil Gilliatt

Dear Linda Dobson,
Thank you for your reply to my FOI request. I would be grateful though, if you could just clarify the following:
In stating that:
"UDC does not pay the bailiff their fees when direct settlement has been made."
Could you please confirm that if the original debt, less the enforcement fees (council's or bailiff's, whatever they're known as) is paid directly to the council, the liability order will then be settled and the bailiff will have no further entitlement to pursue the debtor for costs.
If this is not the case could you please explain the situation in this scenario?
Yours sincerely,
Neil Gilliatt

Dear Linda Dobson,
Thank you, I have noted and read both responses of 3rd and 23rd of May, however, I sent an email to you on 23 May requesting clarification, the contents of which follow:
"Thank you for your reply to my FOI request. I would be grateful
though, if you could just clarify the following:

Dear Mr Gilliatt
Please accept our apologies for not having responded to your subsequent
request seeking clarification of details we provided. I have spoken to
the officer concerned and he advises me that - UDC does not pay the
bailiff their fees however, if the bailiff fees are paid direct to
Uttlesford District Council and full payment has been made in respect of
Council Tax the collected fees will be paid to the bailiff.
Where a step is taken for the recovery of an outstanding sum which is or
forms part of an amount in respect of which a liability order has been
made and under which additional costs or charges with respect to the steps
are also recoverable in accordance with this Part, any sum recovered
thereby which is less than the aggregate amount of the outstanding sum and
such additional costs and charges shall be treated as discharging first
the costs and charges, the balance (if any) being applied towards the
discharge of the outstanding sum.
I confirm that the outstanding sum (Council Tax) will continue to be
pursued by the bailiff until a satisfactory outcome is reached.
I hope that this clarifies the situation for you.
Yours sincerely
Linda
