Dear Powys Council,
1, Which bailiff companies are employed by Powys Council.

2, How often is the contract renewed.

3, Apart from the additional bailiff fees added to the debt , do the council pay the bailiff company any percentage of monies recovered.

4, Do the Council monitor as to whether the chosen bailiff company has any upheld court complaints registered against it or its agents on a regular basis. If not why not.

5, If the company was found to have had any complaints upheld against it in a court, would the council dismiss the company. If not why not.

6, Who is ultimately in charge of employing the chosen bailiff company . This must be the name of an officer /s , and not a department.

        **Contracts with Bailiffs**
 
The above is a summary of your request. The full details of the
information sought is provided to the officer to whom the request is
tasked.
 
Your request will now be considered and you will receive a response within
the statutory timescale of 20 working days as defined by the Act, subject
to the information not being exempt or containing a reference to a third
party. In some circumstances Powys County Council may be unable to achieve
this deadline. If this is likely you will be informed and given a revised
time-scale at the earliest opportunity.
 
There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make a payment then your request will
remain unanswered.
 
Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.
 
The due date for responding to this request for information is 19/09/2014.

Thank you for your request for information dated 14/08/2014 concerning
Contracts with Bailiffs.
 
This is to inform you that your request has been considered and I can
provide the following response:
 
1, Which bailiff companies are employed by Powys Council.
 
Excel Civil Enforcement Ltd
 
2, How often is the contract renewed.
 
The contract is renewed upon expiry, usually every four years.
 
3, Apart from the additional bailiff fees added to the debt , do the
council pay the bailiff company any percentage of monies recovered.
 
The Council does not pay the bailiff company any percentage of monies
recovered, a Zero 0% commission charge applies.
 
4, Do the Council monitor as to whether the chosen bailiff company has any
upheld court complaints registered against it or its agents on a regular
basis. If not why not.
 
As part of the procurement process, the Council asked bidders about such
complaints. The appointed company had no complaints upheld at the time of
tender.      
 
5, If the company was found to have had any complaints upheld against it
in a court, would the council dismiss the company. If not why not.
 
It would depend on the nature of the complaint and whether the Court
imposed sanctions or revoked the bailiffs County Court Certificate, which
may impact on the company’s ability to perform the contract.  Any
judgement may result in a performance notice or termination of contract. 
 
6, Who is ultimately in charge of employing the chosen bailiff company.
This must be the name of an officer /s , and not a department.

Can I suggest you request a copy of the Terms & Condition of the Contract, ensure you ask for the one in place with the current Bailiff Company as well as the one in place ready for a new contract, this ensures you cover the right of the Council to use an updated Contract for future use. Make sure you ask for a copy without the addition of names and rates, this avoids Commercially sensitive information. I used this to obtain copies of contracts with Providers of Domiciliary Care services for Social Services, very very interesting results.

Powys County Council contracts with Excel Enforcement Ltd. Andrew Griffiths is the Council’s, Income Manager and is responsible for the service
