(2009/0062775 and 2009/0062782) received 10 July, under the Freedom of
Information Act 2000 (the Act) seeking information in relation to the
review of home education.

The Department aims to respond to all requests under the Act within 20
working days and normally does so in at least 90% of cases. I am aware
however that this limit has now been exceeded in your case. This has been
due to a number of factors including large volumes of correspondence
resulting from the review into home education. I would however like to
assure you that the Department takes its statutory responsibilities under
the Act very seriously and is always concerned about delays in responding
to individual requesters, recognising the inconvenience and
frustration which this may cause.

Please confirm that "the 90 LAs that responded to our
questionnaire" means that 90 LAs responded to the 60-question
questionnaire issued on 19 January in parallel with the 6-question
questionnaire available to the general public.

I have dealt with your request under the Freedom of Information Act 2000.

Ninety local authorities did respond to the 60 question questionnaire
which ran in parallel with the public questionnaire. The following may
help to clarify further. All top tier local authorities (150) were sent
the local authority questionnaire (Annex D of Graham Badman's report). 90
responses were received. A second questionnaire was sent to the 90 local
authorities who responded to the first questionnaire, 25 of whom
responded. A copy of the second questionnaire sent to the 90 local
authorities is attached.

You may be aware that we have placed some information, previously
disclosed to correspondents about the home education review, onto the
disclosure log on the Freedom of Information link on the front page of the
Department's internet site, and will continue to add information that we

I am not sure to what annex you are referring. All the annexes (annexes A - F) to Graham
Badman's report are available, along with the report, on the Every Child Matters website at

It might help if I explain that an annex has been forwarded in response to a number of requests
to the Department for information on the review of home education. This annex however, forms
part of the response to those replies and was not part of Graham Badman's report. Annexes to
previous FOI requests have referred to questions 1 and 5. These are questions contained in a
working paper `Independent Review of Home Education - safeguarding evidence' which included
information from both questionnaires sent to local authorities. This working paper has already
been forwarded to you under case reference 2009/0067213.
