Background information (2, follow-up request) for Highway Authority opinion on planning applications 14/0964/FUL and 14/0966/FUL

We are writing to request further information on the basis by which the Highway Authority has come to a view on the above application.

BACKGROUND

In document "FOI 4412 App5.pdf" [1], officer Ian Dyer, writing on 7th March 2014 on behalf of the Highway Authority, states:

"The layby option, whilst removing the delivery vehicle completely from the carriageway, raised the concern that, when leaving the layby, the delivery driver may concentrate on pulling out into traffic and, with his attention on that issue, may squeeze a pedestrian against the wall of Number 103.

Given these issues I would feel unable to support either option."

This view is reiterated in a later document, released as "FOI 4412 App3.pdf" [2], in reply to Julian Clarke, of Transport Planning Associates,:

"I note that you disagree with the contents of my letter of 7th March, however I am confident that the concerns expressed by myself and my colleagues in Highway safety are valid and those comments would form the basis of the Highway Authority's advice on the such a proposal, were it to come forward as a planning application."

The case file for the application [3] (14/0964/FUL, and same for 14/0966/FUL) contains, listed against 11th August 2014, an e-mail [4] from Mr Dyer, dated 7th August, stating:

"Lou Mason Wash and I had a meeting with Julian Clark this morning to discuss issues raised regarding the Transport Statement.

Julian is going to provide some additional information.

In the interim, in terms of the servicing layby, I have discussed with a Safety Auditor, and we are content that, subject to detailed design, this will not result in significant detriment to highway safety."

We note that this statement is seemingly in direct contradiction to the earlier opinion.

REQUEST FOR INFORMATION

Please supply the following information:

1) A copy of the layby design submitted to the Highway Authority, on which the view given in "FOI 4412 App5.pdf" dated 7th March 2014, was based.

2) A copy of the design for the layby which it appears would have been considered at the 7th August meeting. (In asking this, we are attempting to determine what change has been made, if any, between 7th March and 7th August, in order to explain the apparent reversal of the Highway Authority's opinion.)

3) Copies of the minutes of the meeting on the 7th of August between Julian Clarke, Ian Dyer and Lou Mason Walsh. If the meeting was unminited, please state this.

4) Copies of any correspondence (which shall include e-mails and paper agendas/minutes) between the applicant and the Highway Authority regarding such a layby subsequent to that which has already been released in our previous FoI request [5].

In the light of the imminent consideration of the applications, if part 4 will take longer to obtain than points 1-3, please send through send those points through as soon as they are available.
