Information Request - 26344733 - Variation of condition attached regarding Toucan crossing for
application ref: 24/0147C I am responding to your request for information, which has been considered under the Environmental
Information Regulations 2004 (EIR) and logged as case 26344733.
Your request is as follows:
In January 2024, Seddon Construction applied to Cheshire East Council to vary the condition
attached to their Manchester Road, Congleton development requiring a Toucan crossing. The
variation of condition application ref: 24/0147C was decided within 2 weeks without consultation. As
a result, the crossing, if built, will now be downgraded to a puffin crossing.
We request access to emails, telephone memos, reports, meeting notes and any other decision
making records that went on internally and between Seddon/Laurus and the Cheshire East Council
members / officers (particularly those in the Highways department and the Planning Department) on
this matter before and after the application to downgrade the Toucan crossing was made.
I confirm that Cheshire East Council holds the information you have requested. However, we consider
that Regulation 6(1)(b) of the EIR applies to the information requested because the information requested
is already publicly available and easily accessible.
All documentation held on the application is readily available to the public online. The information you
requested is available on our website using the following link -

documentation.
