mean total student numbers for each year, or the cumulative student
numbers for the past ten years?

so total course number past 10 years would be for instance ...

in 2017 how many students in total for architecture when years 1,2 and 3 are combined.
same for 2018, 2019 etc.

i know HESA can show this so this part of the request i can do if need be.

Thank you for your email of 27 March 2019 where you requested information
about BA architecture course budget and total student numbers for the past
10 years. We have dealt with your request under the Freedom of Information
Act 2000.

 

I can confirm that we hold this information. There are two parts to your
request;

(1) total student numbers for the past 10 years and

(2) the course budget for the past 10 years. 

 

The information for part (1) of your request is exempt under Section 21 as
you rightly point out in your email dated 5 April 2019 that it is
available elsewhere; in this case the HESA website
([1]www.hesa.ac.uk/data-and-analysis).

 

The information requested for part (2) of your request is exempt under
Section 43(2) of the Freedom of Information  Act 2000. When the
information is exempt under Section 43(2), this is due to commercial
sensitivity of the material being sought. 

   

Section 43 (2) exempts information which, if disclosed, would be likely to
prejudice the commercial  interests of any person. It protects not only
the commercial in commercial interests of the University. It is intended
to protect the ability of a public authority  like the University to
obtain goods or services on the best possible commercial terms and to
protect the  legitimate commercial interests of its suppliers, or to
protect the ability to compete competitively and to remain solvent, e.g.
through the selling of courses.  The information you seek falls into this
category. 

   

Releasing details of the University’s commercially sensitive information
would be likely to prejudice the University and any future suppliers’
commercial interests. It would reveal to their competitors commercially
sensitive financial aspects of the employment
contract/negotiations/plans.  This in turn would prejudice the ability of
the University to secure best value which is also not in the public
interest.

 

Section 43 of the Act is designed not only to exempt information which may
prejudice the commercial interests of the public authority, in the this
case Falmouth University, but also the interests of commercial 3rd parties
such as suppliers of goods and services to the public authority.  In order
to engage a qualified exemption such as this, the public authority must
carry out a public interest test to ascertain whether upholding this
exemption outweighs the public interest in disclosure. It is important to
understand that public interest in this context refers to the public good,
not what is of interest to the public, and not the private commercial
interests of the requester.   In relation to this request it is reasoned
that your request is not sufficiently in the public interest to outweigh
the commercial interests of the University, or its commercial suppliers,
who may or may not be in the process of securing best value for goods and
services at the time of the request.  As the University is funded in part
through public monies, it is not in the public interest to fail to secure
the best possible value for those funds by disclosing the details of
ongoing or planned negotiations.

 

Appeal Process

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
