I'm sorry, for the abruptness of the request but I am used to answering questions of Oxford City Council and they answers have been less than generous or fulfilled

Could you please could you supply ADDRESSES of all B1 to B8 and D1 & D2 properties that are owned by you and either currently empty and/or unused, or the same if they will be so in the next calender year i.e 2014/15

If you could do the same for A1 to A4 properties that are empty and that you own that would be good too, but not a critical issue

Having looked at your request we are seeking clarification on the points
raised in your request.

 

When you refer to B1 to B8 and D1 and D2 properties, what do you mean by
these codes? Are they in reference to council tax bands? We wish to check
to ensure that we are retrieving the correct information.

 

As advised, we require clarification of the points raised before we can
proceed with completing our response to ensure that we are providing the
appropriate information that you require.

 

Whilst we are awaiting your clarification, we will place your request “on
hold” until we receive your response. This extends the 20 working day
timescale which will start again once we receive feedback from our
clarification points above. If we do not receive clarification within
three months your request will be considered to have lapsed.

basically any large organisation with extensive estates tends to have stuff that was built for X beeen reused for y and now is currently empty until Z comes along

And some people who fall within your remit might be that Z

Hi Tom

I've seriously messed up by asking for the information and I wonder if you can help us all by REFUSING to give the information! Also if yo could pass this onto anyone else you know who owrks in the field that would be good. Could you look at the information below and shape a suitable answer - cut and paste from others replies would be fine

Thankfully you haven't replied yet, because i would have hated to open up the NHS to theiving scum who steal from their empty buildings

According to the lawyer for Oxford City Council all public bodies can resfuse to give such information on the grounds that it acts and as an enabler for criminal damage - something i now agree with

"Information which identifies vacant properties may fall within an exemption to disclosure for the prevention of crime (Freedom of Information Act -section 31).

The making public of empty property details runs a serious risk of prejudicing the prevention of crime by making those properties a focus for squatting, criminal damage and other crime. This is supported by the decision in Voyias and applies whether or not the properties are residential, commercial, owned by individuals or limited companies.

In my view the exemption established in the Voyias case would apply to all councils and other public authorities that are subject to the Freedom of Information Act, as long as they have genuine grounds for believing empty properties would become a focus for crime. In Oxford that is certainly the case, in other areas the risk may be less.
