I would also like to request a list of the items on the public register pertaining to Permit JP3535CE.

Dear Enquiries Unit,

On 24 January 2014 you kindly acknowledged my simple request for environmental information, i.e. my request for electronic copies of Annual Incinerator Performance Reports and Compliance Assessment Reports for the Avonmouth Energy Facility (Operated by New Earth Energy (West)Operations Limited at the Former Britannia Zinc Works, BS11 8AZ. Permit ref: JP3535CE)and a list of the items on the public register pertaining to Permit JP3535CE.

You explained that you had passed my enquiry to your local customer team and that they would be in touch with me shortly.

You even explained that a public authority must respond to requests for information within 20 working days, specifying that the latest date that I could expect to receive a response from you was 20 February 2014.

For the avoidance of doubt, I specified that I was making this request under the Environmental Information Regulations.

As you will be aware, these regulations stipulate that the public body must make the requested information available as soon as possible, and no later than 20 working days.

ICO Guidelines clarify that: "you should count the first working day after you receive the request as the first day. You shouldn’t wait until the twentieth day to respond to a request – your main obligation is to provide the information as soon as possible after you receive the request", and that: "Working day means any day other than a Saturday, Sunday, or public holidays and bank holidays...The time allowed for complying with a request starts when your organisation receives it, not when it reaches the information officer or other relevant member of staff".

The 20-working-day deadline has already passed, and in light of this I would like to know if I can expect the information on or by Wednesday 26th February.

If not, then I wish to request an internal review of the decision not to release the environmental information I requested under EIR.

On 31/01/2014, the Environment Agency received an annual report for 2013.
This was substantively deficient. I attach a copy of the Compliance
Assessment Report that we issued for this which gives details of the
non-compliances we believe to have been committed, and the corrective
actions that the operator must take. I also attach a copy of the report
that we received. When reading it, please do so knowing that we are aware
of its shortcomings and have actions in place to have the operator correct
them.
