I am again writing to request an internal review of Bristol City Council's handling of my FOI request 'Avon Crescent'.
I note that you have not confirmed or denied whether the authority holds this information, and have not applied an exemption that would remove this obligation.
As you may be aware, Section 1(1) of the FOI Act (https://www.legislation.gov.uk/ukpga/200...) states that "Any person making a request for information to a public authority is entitled to be informed in writing by the public authority whether it holds information of the description specified in the request".
I would be grateful if you could clarify whether or not this information is held, or specify which exemption of the duty to confirm or deny you are applying.
If I do not get the information that I requested back in July 2021, this week, then I will proceed to the Information Commissioner's Office to complain about Bristol Council's poor behaviour and disregard for the law.

I am writing to request an internal review of Bristol City Council's handling of my FOI request 'Avon Crescent'.
You have provided redacted emails up until October 2020, but none since then as I requested.
It seems to be that you have witheld this further correspondence due to a 'document in the public domain' You do not describe which document you are referring to. I can only imagine that it is a s.73 planning application which correspondence shows as submitted in October 2020. The correspondence also shows that this planning application was not verified at the time, and was not uploaded to the planning portal It is not therefore in the 'public domain'
Please either let me see the correspondence since October 2020, or explain to me which document you are referring to, and why that justifies witholding information.
I cannot see a valid reason for witholding correspondence for the last fourteen months.
I have also written to the Information Commissioners Office making these same points.

On 10th December 2021, I asked you "Please either let me see the correspondence since October 2020, or explain to me which document you are referring to, and why that justifies witholding information."
Please just tell me which document is 'in the public domain' that you are referring to, and why that justifies witholding correspondence from the last fourteen months.
Why do I have to wait until January 14th 2022 for a reply to a simple question?
You appear to be deliberately delaying disclosure. This request dates back to July 2021.
I am dealing simutaneously with the I.C.O. in the hope that they can help me get the information that bristol City Council is legally obliged to give me, but won't.

We received your request for an internal review on the 10^th December 2021
and under FOIA the internal review procedure should provide a fair and
thorough review of procedures and decisions taken in relation to the Act.
This includes decisions taken about where the public interest lies if a
qualified exemption has been used. It might also include applying a
different or additional exemption(s).
The ICO Guidance on FOIA Section 45 Code of Practice states the following
with regards to Internal Reviews
'5.4 Requests for internal review should be acknowledged and the applicant
informed of the target date for responding. This should normally be within
20 working days of receipt.'
Internal reviews are not managed by the same department or person who
provided the original response to ensure that there is a fair and
transparent in the investigation. This means that time is taken to review
the original request, the response provided and the details that are
outlined in the internal review and then to confirm whether the original
response was correct or whether information should now be provided or
whether additional exemptions need to be applied.
Under the Freedom of information Act 2000 an internal review allows the
local authority 20 working days following the receipt of the Internal
Request to fully investigate and therefore allow for all information to be
reviewed and a response provided.
We hope this explains why the timeframe of the 14^th January has been
advised. I can confirm we are actively investigating the points raised in
your Internal Review and shall respond as per our acknowledgement.
