Dear UK Border Agency,
I would like to make the following Freedom of Information request.

The PBS “code of practice section j” salary for analyst programmers, software engineers, senior software engineers and projects managers is obtained using the widely accepted data from Salary Service Ltd (SSL) and based on the National paid lower quartile of salaries from the summer 2008 update. SSL give the following current average paid salaries for these occupations in inner London as:

analyst programmers - £37996
software engineers - £35958
senior software engineers - £49610
projects managers - £70200

For the months March 2010 to May 2010 inclusive using the data from approved Certificates Of Sponsorship (including new CoS issued due to significant changes of employment):

What percentage of tier 2 intra company transfer CoS have been approved where “Nationality” is Indian and who have a “Main work address” OR “Other regular work address” in London and whose “Job Title” or “Job Type” is “Analyst programmer” (under SOC 2132) and whose combined gross salary and allowance is less than £37996?

What is the average combined gross salary and gross allowance from tier 2 intra company transfer CoS where “Nationality” is Indian and who have a “Main work address” OR “Other regular work address” in London and whose “Job Title” or “Job Type” is “Analyst programmer” (under SOC 2132)?

What is the average gross salary from tier 2 intra company transfer CoS where “Nationality” is Indian and who have a “Main work address” OR “Other regular work address” in London and whose “Job Title” or “Job Type” is “Analyst programmer” (under SOC 2132)?

What percentage of tier 2 intra company transfer CoS have been approved where “Nationality” is Indian and who have a “Main work address” OR “Other regular work address” in London and whose “Job Title” or “Job Type” is “Software engineer” (under SOC 2132) and whose combined gross salary and allowance is less than £35958?

Thank you for your email of 29 June where you have further clarified your request for information. This falls to be dealt with under the Freedom of Information Act 2000 and we will endeavour to respond within 20 working days.

We will be proving you with the following information:

Please note that we are unable to provide you with data that " 'joins' Certificates of Sponsorship (CoS) with visa application tables, so that only CoS data for approved visas can be selected". We would have to trawl through each individual record to locate and retrieve this information which would take us over £600 cost limit under the Freedom of Information Act.

As part of the Home Office, the UK Border Agency is not obliged to comply with any information request where the prescribed costs of supplying you with the information exceed £600. The £600 limit applies to all central government departments and is based on work being carried out at a rate of £25 per hour, which equates to 3½ days work per request. Prescribed costs include those which cover the cost of locating and retrieving information, and preparing our response to you.

I am writing to request an internal review of UK Border Agency's handling of my FOI request 'Average Salary on CoS for Software Engineers etc'.

The Home Affairs Select Committee, MAC, and UKBA have been holding consultations on the proposed cap. The impact on public services of migration and fiscal contribution of migrants workers is a key part of these. It is in the public interest that this information is made available.

The split between taxed salary and allowances covered by an HMRC dispensation is important.

I am quite happy to have the requested information for all inner London without post codes so that the identity of individuals and sponsors cannot be inferred.

I now appreciate that you cannot give out the salary and allowance values from individual CoS (for me to calculate the average) even where it would be virtually impossible to identify an individual or company.

As I only want the average, would it be acceptable for the FOI team to calculate this for me from the data that has been withheld?
