Available Benefits

Sarah Conner made this Freedom of Information request to Department for Work and Pensions

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Dear Department for Work and Pensions,

Can you inform me what benefits are available to a person who has applied for ESA and the following has happened

1. Their appeal was not successful after the HCP & DM said they are fit for work, and subsequently upheld at appeal?

2. They are told by the Jobcentre Plus that they are not fit for work and not entitled to JSA, what benefit should the Jobcentre Plus or DWP advise the claimant to apply for?

3. Does the phrase "The law states this is the minimum amount you need to live on." still hold true and if so why isn't it still included on all income based benefit letters.

4. If the phrase "The law states this is the minimum amount you need to live on" has been legally removed from letter informing the claimant how much they need to live on when claiming income based benefits when has this applied from?

Yours faithfully,

Sarah Conner

Dear DWP freedom-of-information-requests,

In my opinion question 2 has not been answered in that the DWP have not stated what other benefits a person is able to claim if refused JSA as they are unable to meet the criteria for claiming JSA.
If a person cannot meet the criteria for ESA but also isn't able to meet the criteria for JSA then surely there must be some benefit they can claim

Yours sincerely,

Sarah Conner

Sarah, they have not answered your question. They are deliberately evading the issue. What you asked is relevant to those who lost their disability benefits.
They choose not to respond because one element of their organisation has found you fit to work while another element actually challenges that assumption.

ASK AGAIN PLEASE

Dear DWP freedom-of-information-requests,

Please clarify that if the person is claimed to not be fit enough for even reduced work i.e. 25 hours then they would get Income Support if told by the Jobcentre Plus they are not eligible for JSA. IMO maybe just does not answer the question as there should be a benefit for those who are turned down for both ESA on the grounds that they are not ill/disabled enough or in the case of JSA not fit enough

Yours sincerely,

Sarah Conner

The question #2 relates to the claimant having no savings and no other income
