Autism and ADHD Assessments (Pilot)
To whom it may concern,
I note that you suggest that, as a charity, you are not subject to Freedom of Information legislation and are not required to respond to requests as a result. In the case of services that are commissioned by the NHS, you are required to do so.
"Significant concerns” were expressed about waiting lists for adult Autism and ADHD services in the Retreat's 2022 report to the Trustees, where it was recorded that the Retreat worked with Commissioners to develop “strict criteria” and prioritisation protocols.
Please provide full minutes, drafts, or notes taken at meetings (formal or informal) discussing:
• The initiation of the autism and ADHD pilot pathway
• The extension of the pilot
• Implications for services commissioned from the Retreat
Please include meetings that took place with the ICB prior to and during the pilot and related communication with the ICB directly regarding the pilot, for example by email.
Waiting List:
• Number of patients on the a) autism b) ADHD waiting list
• Number of patients triaged for assessment for a) autism b)ADHD during the period of the pilot
• Number of patients who have joined the relevant waiting lists during the pilot
• Estimate of new patient waiting time for assessment in a) autism b) ADHD (the period between a patient joining the waiting list and receiving a full specialist assessment, as specified by NICE guidance).
Risk assessment:
Quality and Safety Committee minutes relating to the impact of the pilot on patients, in document form or draft (and/or other evidence of discussions about risk with the ICB)
Feedback or Complaints:
Documents or records of feedback received by the Retreat regarding the pilot (redacted as required).

I am writing to request an internal review of The Retreat York's handling of my FOI request 'Autism and ADHD Assessments (Pilot)' on the recommendation of the ICO.
You state that "The Retreat is a charity and private company providing a specialist secondary mental health service; the Retreat is not a public body and do not provide primary medical or general medical services." That is not relevant to the information requested, which relates to the specialist secondary mental health services (ADHD and Autism assessments).
As I stated in the original request, the ICO have confirmed that charities and private companies are not exempt if they are providing public services.
