Autism and ADHD assessment pilot September Update
Dear NHS Humber and North Yorkshire Integrated Care Board,
We write to request updated information about the pilot autism and ADHD pathway. Please note, as directed by the ICO, that:
“The information you need to provide could include drafts, emails, notes, meta-data, work conversations on messaging platforms, recordings of telephone conversations, and CCTV recordings.”
September Update
Please provide the information that will be/ has been used to inform the September 2023 update Report (as referenced in the timeline in the June 2023 Report). To address but not be limited to the following:
1. Evaluation
- The ICB’s informal and formal response to the Healthwatch evaluation including work conversations on messaging platforms (such as WhatsApp or Teams etc.), documentary evidence (including recordings and drafts) of discussions and meetings, and up-to-date copies of notes, drafts or reports.
Please highlight where the statutory, risk and equality issues raised by the Healthwatch review, have been addressed
- Internal and Do-IT solutions evaluation, either formal or informal (with data redacted as needed for anonymisation) plus communications and discussions about this evaluation
2. Changes
Where changes were made as part of the extension of the pilot:
- Details regarding expanded criteria and use of direct referrals; detailing measures taken to address the high level of risk and harm evidenced to date; and
- Discussions, communications and documentation regarding the development of support groups, workshops and other planned interventions. In particular, conversations and correspondence with Do-IT solutions (if this is held by The Retreat it is your responsibility as the public body to provide this information)
Please include any documents or details about discussions concerning how these plans make use of data gathered via the Do-IT profiler.
3. Coproduction and Engagement
Please provide full information about co-production, consultation, and engagement in particular communications (in all the formats required by the ICO) about the extent of community involvement and evidence of how this has been carried out to date.
Please include a copy of the coproduction and engagement plan (or drafts and notes) for the extended nine-month period.
4. Equality and Risk
Please provide notes and communications about and the most recent draft of The Integrated Impact Assessment (IIA), which includes an Equality Impact Assessment (EIA), and Risk Assessment.
We note that previous responses state that the IIA continues to be developed as the pilot progresses however, assurances that it is intended for the information to be made publicly available are not sufficient to render the information assembled so far to be exempt under Section 22 of the FOI Act. Particularly given the statutory requirement to make the completed assessments public in April 2023.
Please include correspondence or notes about the decision to delay and withhold the release of this information.
Data Protection
Please provide information and correspondence about the lack of a Data Protection Impact Assessment to cover the initial and extended pilot period - highlighting risks and remedies put in place to address these.
Please also evidence claims that the profiler does not make automated decisions or profiling.
We note that documents provided in response to other FOI requests confirm that profiling has been taking place. With this in mind, we request the information used and discussions around making the statement that automated decision-making or profiling isn’t happening.
Other matters:
Individuals
Please confirm and evidence (via redacted metadata) the number of 1) ADHD and 2) Autism assessments completed since the beginning of the pilot, of individuals:
a) on the long-term/ existing waiting list (please also provide any notes or correspondence regarding the impact of the pilot. For example, the prioritisation of urgent assessments as opposed to patients due to be assessed)
b) who have completed the profiler and been informed that they have been referred for assessment due to the immediate and serious level of need.
Urgent Referral, Triage and Intervention for High Risk
Where people have been informed they meet the criteria and referred but not triaged or assessed please detail any information, discussion, or correspondence held about what urgent interventions, if any, are being offered as an alternative.
Procurement:
Please supply a copy of the Do-IT Solutions contract (in draft if necessary, we note that one was in development) and any notes or correspondence regarding payment for a) services supplied to date b) for the extension of the pilot and c) the development of further services from Do-IT solutions (e.g. workshops).
Note:
Please also supply information where requested if it is held by other organisations. We have sought clarification that it is your responsibility as the public body to provide this information when other organisations provide a public service and handle data relating to this. To cover, for example, information held by The Retreat, TEWV, or ‘Places’. The same rules apply, by extension, to Do-IT Solutions.
We anticipate that the ICB will secure and supply the information previously recorded as not held. We will list this for your information as an additional FOI request.
