Dear Office of Communications,

The body known as ATVOD, appears to have been comprised of individuals with an impartial view, and independent of any vested interests..However upon examination, all parties concerned do indeed have vested interest, and this is totally verifiable , therefore I would like to know who was responsible for electing these representatives. as it would, given the candidates elected, appear to be a case of Malfeasance in Public office

Freedom of Information: Right to know request
Thank you for your request for details relating to selection of
representatives for the Authority for Television on Demand (“ATVOD”).
We received your request on 28 July 2014 and have considered it under the
Freedom of Information Act 2000 (‘the Act’).
Before responding to your specific questions, I should clarify the
relationship between Ofcom and ATVOD.
As you may be aware, Ofcom has general duties in relation to the
regulation of those who provide on demand programmes via the internet,
known as On Demand Programme Service (ODPS) providers. We work in
conjunction with ATVOD as the co-regulator for editorial content.
Ofcom designated ATVOD in 2010 as the appropriate regulatory authority to
carry out certain aspects of its functions in relation to the provision of
ODPS including to decide:

* what constitutes an ODPS (in accordance with Section 368A of the Act);
* whether or not a person is providing an ODPS;
* what constitutes a programme included in an ODPS (in accordance with
Section 368R(2) of the Act;

* whether or not a person who is providing an ODPS has contravened the
regulatory requirements.

A determination made by ATVOD in respect of what constitutes an ODPS and
whether or not a person is providing an ODPS may be subject to appeal by
Ofcom.
Turning to your specific question, ATVOD was originally a self-regulatory
membership-based organisation, and, following a consultation process on
the designation of regulatory duties for Video on Demand Services was
remodelled into an industry wide co-regulator for the purpose of ensuring
compliance with the regulations, which duties Ofcom then delegated to it
in 2010.
As part of that process, ATVOD, with the cooperation of industry
stakeholders and Ofcom, undertook a range of activities with a view to
ensuring that it would be fit-for-purpose to be designated as a
co-regulatory body, including the recruitment of a new Chief Executive
Officer, Chairman and new independent members of the ATVOD Board.

The designation of the regulation of ODPS to ATVOD was subject to review
by Ofcom in 2012, which included an assessment by Ofcom of how ATVOD had
discharged the designated functions and met its obligations. More details
