Audit Reports: FOI Performance
Dear Sirs
FREEDOM OF INFORMATION (SCOTLAND) ACT 2002
REQUEST FOR INFORMATION
The Scottish Information Commissioner (SIC) recently released a report concerning Failure to Respond (FTR) cases received by her office in which the Scottish Ministers featured. In pursuance of the general right of access to information contained within the Freedom of Information (Scotland) Act 2002 (FOISA) I request the following information from the Scottish Ministers:
(a) the full content of any internal audit report published on or after 1 April 2012 concerning the performance of the Scottish Ministers relative to compliance with FOI legislation together with any action plan (or similar) relative thereto
(b) the full content of any external audit report published on or after 1 April 2012 concerning the performance of the Scottish Ministers relative to compliance with FOI legislation together with any action plan (or similar) relative thereto
(c) the full content of any correspondence between the Scottish Ministers and SIC concerning compliance with section 10(1) and 21(1) of FOISA and Regulation 5(2)(a) of the Environmental Information (Scotland) Regulations 2004 (EIRs), excluding that which was sent in the course of an investigation by SIC pursuant to section 47(1) of FOISA. This part covers correspondence sent or received between the period 1 January 2014 to 15 August 2014.
For the purposes of this request, and for the avoidance of doubt, FOI legislation means both FOISA and the EIRs. Furthermore, parts (a) and (b) of this request are not confined to FTR issues, but extend more generally to compliance with FOI legislation.
Should the Scottish Ministers reasonably require any clarification in order to enable them to progress this request I should be obliged if the Ministers would contact me at the earliest opportunity in order that such clarification reasonably required can be provided.
I look forward to receiving your response to this information request.
Yours faithfully,
Alistair P Sloan
